Dear Sir:
Reference is made to your letter dated January 24, 1968
concerning V-32-67.
Your letter indicates that because of the approval of and
the reesmendation to the City Ceunoil for approval of V-32-67 by the
Planning Department, you have no alternative but to issue a building
permit for a two story addition.
I attended the meeting of the Planning 8ommiision held January
8, 1968. It was my understanding that the Planning Commission •nly ap-
proved the encroachment request.
To further support by understanding the following excerpts are
taken from the minutes of this meeting, which is signed by William L.
Dunn, Secretee'y and Director of Planning.
Taken from page five of the minutes.
Quotes.
"Mr Reade asked the Assistant City Attorney for a ruling as
to the Commission*s position with regard to deed restrictions.
The Assistant City Attoeney advised that the Commission is not
involved with the deed restrictions and that they are only ao-
ting upon the encroachment request.
The Director of Planning then wished to advise the audience
that the Planning Commission •nly voted on the the encroach-
ment request and in no way considered the two story part of
the request."
It appears to me that your department does have an alternative
and that the ruling of the Planning Commission butts youroffiue
to acting on the encroachment only. And the deed rstriction
limits your office to a one story structure.
Based on the ruling of the Planning Commission and the deed re-
striction your office is limited to a one story structure build-
ing permit der V-32-67.
