Dear Mr. Marck:
Review of the zoning application for the above-referenced property has been
completed. The appiication has been approved, based on the following
background, project description, and findings, subject to the conditions set forth
below:
BACKGROUND
The existing residence has an attached 1-car garage at the front of the property and
a 600 sq.ft. detached accessory structure at the rear. The applicant stated that the
accessory structure was originally a garage but the previous owner had converted it
to a hobby shop. There is no vehicle access to the detached accessory structure.
PROJECT DESCRIPTION
The applicant proposes to Convert the detaChed accessory structure into a
recreation room. A minor conditional use permit is required because a powder room
containing a toilet and a sink is proposed as a part of the conversion. The applicant
would like to have the fixtures installed for convenience purposes when using the
recreation room, rather than having to go to the main residence to use the
restroom. The powder room is of the minimum size to accommodate the two
fixtures.
To minimize the possibility of conversion to a separate dwelling unit, a condition
has been included prohibiting a bathtub or shower in the accessory building.
Additionally, the property owner will be required to record a land use restriction to
inform future property owners that the accessory building cannot be used as a
dwelling unit.

FINDINGS
A. The information presented complies with Costa Mesa Municipal Code section
13-291g112) in that the proposed improvement is compatible with developments
in the same general area. Granting the minor conditional use permit will not be
detrimental to the health, safety, and general welfare of the public or other
properties or improvements within the immediate vicinity. Specifically, the
powder room is of the minimum size to accommodate the toilet and sink. The
structure is restricted to having only one toilet and one sink, with no bathtub or
shower. A condition has also been included requiring the property owner to
record a land use restriction to inform future property owners that the accessory
building cannot be used as a dwelling unit. Granting the minor conditional use
permit will not allow a use, density, or intensity that is not in accordance with
the general plan designation for the property.
B. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQAI, the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
C. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 1 3 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
Ping. 1. The detached accessory structure is resiricted to having only one toilet
and one sink. A bathtub and/or shower are prohibited.
2. The accessory building shall not be used as a dwelling unit.
3. The detached accessory structure and powder room shall be served from
the same utility meters (electric, gas, and water) as the main dwelling
unit on the property.
4. A land use restriction shall be recorded prior to the issuance of building
permits. This land use restriction shall inform future property owners that
ihe detached accessory structure shall not be used and/or sold as a
secondary dwelling unit. The applicant shall submit to the Planning
Division a copy of the legal description for the property, and either a lot
book report or current title report identifying the current legal property
owner so that the document may be prepared.

regard to building materials, style, colors, etc. Plans submitted for plan
check shall indicate how this will be accomplished.
6. Any new mechanical equipment such as air-conditioning equipment and
duct work shall be screened from view in a manner approved by the
Planning Division. Roof mounted equipment is prohibited.
7. Construction, grading, material delivery, equipment operation, or other
noise-generating activity shall be limited to between the hours of 7 a.m.

and 8 p.m., Monday through Friday, and between the hours of 8 a.m.
and 6 p.m. on Saturday. Noise-generating activity shall not be allowed
on Sunday or Federal holidays. Exceptions may be made for activities
that will not generate noise audible from off site, such as painting and
other quiet interior work.
8. The applicant shall contact the Planning Division to arrange for an
inspection of the site prior to the release of utilities. This inspection is to
confirm that the conditions of approval and code requirements have been
satisfied.
9. The minor conditional use permit herein approved shall be valid until
revoked, but shali expire upon discontinuance of the activity authorized
hereby for a period of 180 days or more. The minor conditional use
permit may be referred to the Planning Commission for modification or
revocation at any time if the conditions ot approval have not been
complied with, if the use is being operated in violation of applicable laws
or ordinances, or if, in the opinion of the development services director or
his designee, any of the findings upon which the approval was based are
no longer applicable.
10. The conditions of approval and ordinance or code provisions and special
district requirements of Zoning Application ZA-04-41 shall be blueprinted
on the face of the site plan.
11. A copy of the conditions of approval for the zoning application must be
kept on the premises and presented to any authorized City official upon
request. New property owners shall be notified of conditions of approval
upon transfer of ownership of the land.
Eng. 12. Maintain the public right-of-way in a"wet-down" condition to prevent
excessive dust and remove any spillage from the public right-of-way by
sweeping or sprinkling.
CODE REQUIREMENTS
The following list of federal, state and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to
the City of Costa Mesa.

received by Planning staff prior to the expiration of the zoning action.

Title 24, aiso known as the California Building Standards Code, as
amended by the City of Costa Mesa.
Eng. 3. At the time of development submit for approval an off-site plan to the
Engineering Division and grading plan to the Building Division that shows

sewer, water, existing parkway imprbvements and the limits of work on
the site, both prepared by a civil engineer or architect. Construction
access approval must be obtained prior to building or engineering permits
being issued by the City of Costa Mesa. Pay offsite plan check fee to the
Engineering Division. An approved offsite plan and fee shall be required
prior to engineering/utility permits being issued by the City. This
requirement is contingent upon a job evaluation of $10,000.00 or more.
4. A site access permit and deposit of $350.00 for street sweeping will be
required by the Engineering Division prior to the start of any on- or off-
site work.
SPECIAL DISTRICT REQUIREMENTS
The requirement of the following special district is hereby forwarded to the
applicant:
Sani. 1. Appiicant shall pay all current Sanitary District sewer connection
charges. Contact Sanitary District at (714) 754-5307 for information.
Upon receipt of this letter, your project has been approved, subject to the above-
listed conditions. A copy of the conceptually-approved plans are enclosed. The
decision will become final at 5 p.m. on September 16, 2004, unless appealed by an
affected party (including filing of the necessary application and payment of the
appropriate fee) or by a member of the Planning Commission or City Council.
