THIS AGREFMEtdf, dated � o2G � , is made by the CITY OF �STA
MESA, a mimicipal corporation (CITY), �9y,/Z, C//,���$ (DEVELOPER),
and � 5� (Et�INEER) in Costa Mesa, California.
W I T N E S S E T H
WHEREAS, the CITY has established a procedure whereby a IE,'VELOPER may
retain the services of a qualified independent ENGI[�ER to perfozm the building
plan review nounally conducted by the CITY or its �ivate contractors; and
4d-IEREAS, DEVELOPER �oposes t,o utiliae the accelerated plan review pr�
cess in connection with the �oposed development of �operty located at -2 %�o
����^-f (�t� in the City of Costa Mesa; and
WHEREAS, ENGINEER represents that he is duly licensed by the State of Cal-
ifornia, and that he shall meet all minimwn qualifications ard responsibilities
required by CITY as hereinafter stated; and,
WHEREAS, DEVELOPER understands and agrees that no building pettnit shall be
issued until all requiranents and conditions of this agreanent have been sati�
fied; and
w[tEReAS, Et�INEER represents that he has that degree of specialized expex�
tise contenplated within California Goverru�nt Code Section 37103 and hoZds all
necessary licenses to practice and perforni the services herein crontenplated; and
hffiEREAS, no official or anployee of QTY has a finanCial interest in the
subject matter o� this agreanent contenplated within the prwisions of California
Goverrunent Code, Sections 1090-1092; and

WHEREAS, E[�INEER declares that he shall perfonn the services herein corr
tenplated in canpliance with the Federal and California Laws related to minumnn
Murs arcl wages, (40 U.S.C. 276 A et seq and California labor Code Section 6300
et seq and California Labor Code, Section 1410 et seq), to the extent same are
applicable herein.
NOW THEREFORE, in consideration of the mutual pronises of the parties, and
other goal and sufficient consideration, the parties ac�ee tn the following:
I. BUILDING PLAN REVIEW SFS2VICES
A. CITY does hereby agree to accept ENGIt�ER to perfoLm buildirx� plan review
in accordance with the tezms and conditions herein set forth.
B. EDGINEER shall review plans for canpliance with pertinent City and State
regulations falling within the purview of the buildirg official of the
City of Costa Mesa.
II. FEES FqR BUILDING PLAN REVIEF] SERVICE
A. Fees for perfozmirg the building plan review shall be negotiated between
DEVELOPER and the ENGII�ER and said fees shall be paid to ENGINEER by
IIEVEL�ER. The CITY shall not be responsible to ENGINEER to any extent
for the fee owed by DEVII,OPER. CITY shall not be called upon to assinne
any liability for the direct or indirect payment of the fee owed by
DEVELOPER or of any salary, wage, or canpensation t� any person anployed
by EIJ„INEER.
B. At the time the buildirg pecmit is issued, an administrative fee equal
to 25 percent of wtiat would normally have been the plan check fee, ha9
the plans been c3�ecked by the CITY, will be chazged and collected by the
CITY. This fee will be _in addition to the building permit fee.
III. LIABILITY EXP06URE AND COVERAGE
A. All officers, agents, employees, arc] subcontractors, and their agents,
officers, and anployees who are hired by or engaged by ENGINEER in the
perfocmance of the building plan review, shall be deaned officers,
agents, and enployees and subcontractors of ENGIt�ER only and City
shall not be liable for their acts or anissions nor responsible to then
for anythirg whatsoever.

B. EN�INEER and DEVELdPER shall each separately indannify and save harmles.
CITY, its officers. arx3 its enployees, fran and against any and all dam-
ages ta property or injuries t�, or death of any person or persons, irr
cluding property ar�d anployees of CI7Y, and shall defend, save haxmtess,
arcl indemnify CITY, its officers, and its employ�ees, fran and against any
and all cleims, demands, liabilities, suits, actions, proceedings, or
judgments therefore, resulting fron or arising out of their own negligent
acts or anissions or the �egligent acts or anissions of their respective
employees or subcontractors; except that neither FNGINEER nor Lf;VELOPER
shall hereby incur any such obligation for the negligent acts or anissions
of the other.
C. ENGINEER shall obtain and maintain the following insurance cwerage:
1. CQ7PREHENSIVE GENERAL LIABILITY coverage with policy lunits of not
less than 51,000,000 ccmbined sirg le limit per occurrence, with CITY �
as additional ins�ed. and with an endorsement that the ins�sance
prcx�ided the CITY as additional ins�med shall he deened prunary and
noncontributing with any other insurance of CITY.
2. PR�FESSIONAL, LIABILIT'Y coverage for 51,000,000 with a contractual
liability provision sufficient to insure Paragraph III.B. above.
3. iJORKER'S �MPENSATION II�URANCE in statutory a�nourrt.
4. The general and professional liability insurance shall provide con-
tinued coverage for at least 12 m�nths following canpletion of con-
struction of the project and shall not be cancelled, m�dified, or
reduced without first giving QTY thirty (30) days written notice.
D. ENGINEER shall provide CITY certificates of insisance acceptable to the
City Attnrney showirg the above ca�erage and policy endorsenents prior
to crnvicencement of any plan check seroices.
IV. GENERAL CdNDITIONS
A. The II9GINEER sha11 conply with all the praaisions of the Worker's Canperr
sation Ins�ance and Safety Acts of the State of California, the appli-
cable prcwisions of Division 4 and 5 of the California Labor Code, and
all amendments thereto, arci regulations adopted pursuant theretn by the
State Department of Iabor and similar State or Federal acts or laws
applicable.
B. IIJ�INEER shall certify in a form and manner acceptable to CITY that the
plans he has checked canply with all applicable codes, ordinances, arid
laws relatirg to the particular type of developme�t proposed and that
permits may by issued for the construction of same.
C. If anissions or errors in the plans are discwered during the course of
construction, corrections shall be made at rio cost tn CITY, and. all rx�rk
perfoimed shall be required to canply with the codes ard ordinances of
CITY �ior to final building inspectian.

D. DEVE[,OPER shall, prior to or concurrently with the building plan review t
by ENGINEER, crontact the Planning Division, Fire Marshal, and/or Public
Services Department of CITY, the Costa Mesa Sanitary District and/or the
Mesa Consolidated 4dater District to determine any conditions or special
requirenents which may be administered by those deparGnents. Failure to
do so may delay issuance of building permits.
E. The licensed arc3iitect, registered erx�ineer, or other authorized person,
entity, or corporation who prepared or supervised preparation of the
project plans, specifications, and/or engineering calculations beirig
reviewed, shall not be associateci in any way with ENGINEER.
V. RESPONSIBILITIES OF EtdGINEER
E[�II�ER shall review plans for canpliance with pertinent CITY and State
regulations fallirg within the purview of the buildirg official of the CITY.
P1ore specifically, the secvices to be perfo nned by ENGIt�ER shall consist of
but not be limited to:
PLAN CHECK
a. Classify the building and verify canpliance for the following:
1) cxcupancy group
2) Type of construction
3) Ir�cation on property
4) Floor area
5) Height and number of stories
6) Occupant load
b. Verify canpliance of the building with detailed occupancy requirements.
c. Verify conpliance of the building with detailed type of construction
requiranents.
d. Verify canpliance of the buildirg with exit requirements.
e. Verify canpliance of the building with detailed Code regulations.
f. Verify canpliance of building with ergineerirx� regulations and requir�
ments for materials of construction.
g. Verify canpliance with California Title 24 by reviewing mechanical and
electrical plan schedules and work sheets for thennal insulation.
h. Verify canpliance with California Title 25 and Section 13-144 of the
C�ta Mesa Mimicipal Ordinances by reviewirg mechanical, electrical, and
plimbirg plans, details, calculations, and any required Acoustical F�gi-
neer's report.
i. Prwide the followirg:
1) Coon-iinate with City Engineerirg personnel for grades determination.
2) Provide drainage review by CITY Ordinance
3) Check drainage flow "p" calculations.
j. Review plumbing, electrical, and heating drawings.
k. Prv,ride for review and verification of all of the above itens imtil all
corrections are made and all data are in canpliance with all codes, ordirr-
ances, arc3 State and Federal Laws.

above statement of conditions, requir�nents, and direction and agree to pe�
form accordingly. Fiirtheunore, they imderstand that no building permits
shall be issued for any project imtil these requirements have been satisfied,
and they certify that no work has been undertaken by the ENGINEER involvirx�
plan check services prior tn sut�nittal of the required certificates of irr
surance ard prior to ap�xwal .of s�ne by the Costa Mesa City attorney.
SIGNAT[JRES
A. The Director of Development Services or his designee is authorized to
execute this agreement on behalf of the City of Costa Mesa when the
parties meet the conditions listed herein.
B. The DEVE[,OPER is defined as the fee title property owner or the tenant
for which the impravements are beirg constructed. If the fee title
property owner or tenant is a corporation or general partnership, an
officer of the corporation or a general partner shall execute this
agreement.
