Subject: Alleged illegal fourth unit - 183 & 185 Delmar Ave
Dear Mr. & Mrs. Laine:
After an extensive investigation, and review of existing documents, the City of Costa
Mesa has determined there is insufficient documentation to conclude whether your
property at 183 Del Mar had, in fact, been approved for three units or four units. This is
due to the fact the property was developed, in part, prior to the incorporation of the City
in or around the 1940's and later expanded in 1966 after the City's incorporation in 1953.
As you purchased the property in good faith in 1989, believing it to be a four-unit
building, and have not performed any changes to the structure, we are inclined to weigh
what evidence we have in your favor.
While under current zoning codes the property would only be approved for three units,
the City has determined to deem 183 Del Mar as "Legal Non-Conforming" and allow
the existing fourth unit to remain. It should be made clear the aforementioned
classification applies only to the current structures, and not to any future redevelopment
of the site.
We must also advise you that if any of the units on your property are ever removed or
destroyed, or any new development on your property is contemplated, all then-current
zoning and development standards for the City of Costa Mesa will apply.
The Code Enforcement action on this property will be closed, with no further action.
A copy of this decision will be placed in the Code Enforcement file and the building
permit file for future reference.
