Dear Mr. Kates:
The minor conditional use permit and minor design review for the above-referenced
project has been completed. The application has been approved, based on the
following project description and findings, subject to the conditions set forth below:
PROJECT DESCRIPTION
The subject property contains an existing two-story single-family residence with an
attached garage and a detached, one-story 640 square foot structure which was
originally permitted and constructed as a playroom. The detached playroom,
identified on the submitted plans as a"guest home" contains a living room,
bedroom, kitchen, and bathroom with a sink, toilet, and shower. There are no
building permits for this construction. Because the detached structure contains a
kitchen it is considered a dwelling unit under the Zoning Code. The R1 zone allows
only one dwelling unit for the property. The applicant is requesting a minor
conditional use permit to legalize the construction as an "incidental residential use".
A condition of approval has been incorporated requiring a land use restriction be
recorded on the property to intorm future property owners that the incidental
residential structure shall not contain a kitchen and shall not be used as a living unit.
Additionally, the incidental residential structure shall be served from the same utility
meters (electric, gas, and water) as the main dwelling unit on the property.
The applicant is also proposing to construct a 276 square foot second-story deck on
the rear of the main house. Because the existing second floor is greater than 50
percent of the first floor, a minor design review is required for the deck. No privacy
impacts to adjacent properties are anticipated because the second floor deck is set

standards and with the residential design guidelines.
FINDINGS
A. The information presented substantially complies with Costa Mesa Municipal
Code Section 13-291g1(141 with regard to the minor design review in that the
project complies with the City of Costa mesa Zoning Code and meets the purpose
and intent of the Residential Design Guidelines, which are intended to promote
design excellence in new residential construction, with consideration being given
to compatibility with the established residential community. The proposed
construction complies with the intent of the residential design guidelines because
no privacy impacts to adjacent properties are anticipated. The second floor deck
is set back more than 30 feet from the south (left side) property line and greater
than 40 feet from the north (right side) property line. Additionally, the rear of the
property does not abut any residential properties. This minor design review
includes site planning, preservation of overall open space, landscaping,
appearance, mass and scale of structures, location of windows, varied roof forms
and roof plane breaks, and any other applicable design features.
B. The minor conditional use permit substantially complies with Costa Mesa
Municipal Code Section 13-291g1(2) in that the proposed use is substantially
compatible with the existing use. Granting the minor conditional use permit will
not be detrimental to the health, safety and general welfare of the public or other
properties or improvements within the immediate vicinity. Specifically, the
recommended conditions of approval will ensure ihat the use will not be
materially detrimental to the health, safety and general welfare of the public or
otherwise injurious to property or improvements within the immediate
neighborhood. A condition of approval has been incorporated requiring a land use
restriction be recorded on the property to inform future property owners that the
incidental residential structure shall not contain a kitchen and shall not be used as
a living unit. Additionally, the incidental residential structure shall be served from
the same utility meters (electric, gas, and water) as the main dweiling unit on the
property. The minor conditional use permit will not allow a use, density or
intensity which is not in accordance with the general plan designation for the
property.
C. The proposed project complies with Costa Mesa Municipal Code Section 13-
29(e) because:
• The proposed development and use is compatible and harmonious with
uses on surrounding properties. .
• Safety and compatibility of the design of the buiidings, landscaping, and
other site features inciuding functional aspects of the site development

such as automobile and pedestrian circulation have been considered.
• The project is consistent with the General Plan.
• The pianning application is for a project-specific case and does not
establish a precedent for future development.
D. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
E. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
Ping. 1. Street addresses shall be displayed on the fascia adjacent to the main
entrance or front door in a manner visible from the public street.
Numerais shall be a minimum 6 inches in height with not less than %z-
inch stroke and shall contrast sharply with the background.
2. The conditions of approval and ordinance or code provisions and
special district requirements of ZA-04-56 shali be blueprinted on the
face of the site plan.
3. All new and existing construction shall be architecturally compatible
with regard to building materials, style, colors, etc. Plans submitted
for plan check shall indicate how this will be accomplished.
4. Grading, materials delivery, equipment operation and other
construction-related activity shall be limited to between the hours of 7
a.m. and 8 p.m., Monday through Friday, and between the hours of 8
a.m. and 6 p.m., on Saturday. Construction is prohibited on Sundays,
and Federal holidays. Exceptions may be made for activities that will
not generate noise audibie from off-site, such as painting and other
quiet interior work.
5. The wet bar shall be deleted from incidental residential structure.
6. The incidental residential structure shall not be used as a dwelling unit.
7. Any kitchen or kitchenette is prohibited in the detached accessory
structure.
8. A land use restriction executed by and between the applicant and the
City of Costa Mesa, shail be recorded prior to the issuance of building
permits. Applicant shall submit to the Planning Division a copy of the
legal description for the property, and either a lot book report or current
title report identifying the current legal property owner so that the
document may be prepared.
9. The land use restriction shall inform future property owners that the
incidental residential structure shali not contain a kitchen and shall not
be used as a living unit.

10. The incidental residential structure shall be served from the same utility
meters (electric, gas, and water) as the main dweliing unit on the
property.
11. The applicant shall contact the Planning Division to arrange for an
inspection of the site prior to the release of occupancy. This inspection
is to confirm that the conditions of approval and code requirements have
been satisfied.
Eng. 12. Maintain the public right-of-way in a"wet-down" condition to prevent
excessive dust and remove any spillage from the public right-of-way by
sweeping or sprinkling.
CODE REQUIREMENTS
The fotlowing list of federal, state and local laws applicable to the project has been
compiled by staff for the developer's reference. Any reference to "City" pertains to
the City of Costa Mesa.
Ping. 1. All contractors and subcontractors must have valid business licenses
to do business in the City of Costa Mesa. Final inspections, final
occupancy and utility releases wiil not be granted until all such
licenses have been oblained.
2. Approval of the zoning action is valid for one (1) year and wiil expire
at the end of that period unless building permits are obtained and
business commences or the applicant applies for and is granted an
extension of time.
3. Development shall comply with all requirements of Article 1, Chapter V,
of Title 13 of the Costa Mesa Municipal Code refating to development
standards for single-family residential projects
4. Any mechanical equipment such as air-conditioning equipment and
duct work shall be screened from view in a manner approved by the
Planning Division.
Bldg. 5. Comply with the requirements of the Uniform Building Code as to
design and construction and CCR Title 24 pertaining to "Disabled
Access regulations".
Eng. 6. At the time of development submit for approval an off-site plan to the
Building Division that shows sewer, water, existing parkway
improvements and the limits of work on the site, prepared by a civil
engineer or architect. Construction access approval must be obtained
prior to building or engineering permits being issued by the City ot
Costa Mesa. Pay off-site plan check fee to the Engineering Division.
An approved off-site plan and fee shall be required prior to
engineering/utility permits being issued by the City.
7. A construction access permit and deposit of 5350 for street sweeping
wiil be required by the Engineering Division prior to the start of any
on- or off-site work.

Fire 8. Provide an approved smoke detector to be installed in accordance with
the 2001 Edition of the Uniform Fire Code.
SPECIAL DISTRICT REQUIREMENTS
The requirement of the following special districts are hereby forwarded to the
applicant:
Sani. 1. Developer shall contact the Costa Mesa Sanitary District at (949) 631-
1731 for current district requirements.
School 2. Pay applicable Newport Mesa Unified School District fees to the Building
Division prior to issuance of building permits.
State 3. Comply with the requi[ements of the California Department of Food and
Agriculture (CDFA) to determine if red imported fire ants (RIFA) exist on
the property prior to any soil movement or excavation. Call CDFA at
(714) 708-1910 for information.
Upon receipt of this letter, your project has been approved, subject to the above-
listed conditions. A copy of the conceptually-approved plans is enclosed. The
decision will become final at 5 p.m. on October 14, 2004 unless appealed by an
affected party or by a member of the Planning Commission or City Council.

The Costa Mesa Planning Department has been notified of the completion of
your swimming pool,
So that your pool will be a safe one and for the purpose of advising
you of your responsibility regarding the requirements of the Costa Mesa
Municipal Code, we quote Section 9296,9a
1, No swimming pool shall be constructed closer than five (5)
feet to any property lines, measured from water line of pool,
2, No swimming pool shall be constructed under any electric power
lines or on any electric power easement,
3, No swimming pool shall be constructed unless the yard surrounding
such pool is completely enclosed by a fence sfx (6) feet in height
and has a self-closing and locking type gate or gates.
This courtesy letter is directed to you so that you will be aware of
our ordinances and can make a complete safety check of your pool area,
