Attention Mike Bingham RE: State Housing Code Enforcement From: Donald Dungan Recently the Planning Commission and the City Council granted a variance to allow an eave overhang of 3-1/2 feet into a 5 foot side yard for a single family dwelling. This, of course, conflicts with the provisions of the State Housing Act and the question is whether your department should issue a building permit on plans which are in compliance with City Council approval but which technically do not meet the minimum standards of the State Housing Act. It is, of course, incumbent,upon the Building Department to enforce the State Housing Act but it is equally important that the Building Department act in accordance with the rules and regulations established or approved by the City Council of the City of Costa Mesa. In instances where these two conflict, sound judgment should be used and where health and safety are involved there should be no question. Where the conflict is more technical then reasonable and sound discretion should be used. Specifically, an eave overhang 8" over and above the minimum requirements of the State Housing Act, which has the approval of the City Council, should be allowed unless, in the opinion of your Department, it is a direct menace to life, health and safety. I am enclosing a copy of a memorandum which I have sent to the Planning Department which I hope will reduce, in the future, situations referred to above. Most of these questions will relate to State Housing and Building Code requirements. Your personnel should be instructed to, first, familiarize themselves as far as possible with the overlapping provisions of the Building Code and the State Housing Code, and, secondly, if they have any doubt about the matter to check with the Planning Director or the Office of the City Attorney.
