This letter is to confirm how the City would apply the nonconforming rebuild
policy to the subject property.
It is my understanding that two residences exist on the site. Because the
property is zoned for single-family residences only, the property is
nonconforming. The code states that if legally constructed residences in an
residential zone are unintentionally destroyed by any means, the residences
may be reconstructed. However, the following provisions shall apply to the
reconstruction of legal, nonconforming dwelling units:
1. Any reconstruction allowed must be started within a period of one year.
2. Reconstruction must be carried out diligently to completion.
3. The restoration must be of an equal or lesser degree of nonconformity.
Please be aware that this ability to rebuild units is only valid as long as the
City's Zoning Code contains these provisions. If the Zoning Code provisions
were to change, the code in existence at that time would be applied if a
request to rebuild was made.
