I have a problem created by my neighbor and am at a loss
how to proceed, On the sauth side of my home (approximately
5 feet from the house) there was a bank cut to the proper
slope at time ❑f construction. Subsequently the slope was
planted with ivy, whi�h prevented any erosion or danger of
slipoage,
However, a•Few months ago, his son hought a larger boat
(the space is used for boat storage) and the neighbor cut
the bank straight down from the property line, stating that
he would be installing a retaining wall immediately. Now
the ground is cracking close to the house and we fear a
real disaster when the rains start. Ironically, the neighbor
was �onstruction superintendent for Mike Koll, who built the
homes.
I called your office and was told this was strictly a civil
matter between me and Mr. Frank Wilson, Are there not laws
which prevent an action of this type? I would greatly
appreciate your advice.

ing wall which will be n cessary to conform to a City or-
dinance which reads in pa t: "Section 2802 (b) Protection
of Adjoining Property. person making or causing an
excavation to e made to a pth of twelve feet (12�) or
less, below t grade, shalZ.protect.the excavation so
that the soil o adjoining property will not cave in or
settle, ------"
We must ask that you apPly for a permit to construct
a retaining wall or return the bank to its original condi-
tion.
