HomeMy WebLinkAbout04-65 - Denying General Plan Amendment, Rezone, Planning Applications, and Tentative Tract MapRESOLUTION NO. 04_65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA DENYING GENERAL PLAN AMENDMENT GP -03-03, REZONE R-03-01, PLANNING APPLICATIONS PA-03-59/PA-04-40 AND TENTATIVE TRACT MAP T- 16502 AT 2300 HARBOR BOULEVARD AND 380 WEST WILSON STREET. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa adopted the 2000 General Plan on January 22; 2002; and WHEREAS, the General Plan is a long-range, comprehensive document that serves as a guide for orderly development of Costa Mesa; and WHEREAS, by its very nature, the General Plan needs to be updated and refined to account for current and future community needs; and WHEREAS, an application was filed by Mark Korando, Vice President of Habitat for Humanity of Orange County, authorized agent for ICI Development (property owner), with respect to the real properties located at 2300 Harbor Boulevard and 380 W. Wilson Street, requesting: (1) General Plan Amendment GP -03-03 to change the General Plan land use designations from General Commercial (2300 Harbor Boulevard) and High Density Residential (380 W. Wilson Street) to Low Density Residential; 2) approval of Planning Application PA -03-59, Final Master Plan for a eight -unit, detached, common -interest residential development; (3) approval of Tentative Tract Map T-16502, subdivision of the property into eight lots and one common lot for parking/ingress/egress/open space purposes; and (4) approval of Planning Application PA -04-40, amendment to Harbor Center Master Plan's (PA -98-50) Conditions of Approval to reflect opening of Wake Forest Road to provide site access; and WHEREAS, the City Council of the City of Costa Mesa approved the General Plan Screening request for the proposed project on December 2, 2002; and WHEREAS, the City conducted community meetings to review the environmental document and proposed project on August 31, 2004 and September 14, 2004 and forwarded responses to substantive comments received during the meetings to the Planning Commission and City Council for consideration; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on September 27, 2004 and by the City Council on October 18, 2004; and WHEREAS, the project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and an Initial Study/Mitigated Negative Declaration was prepared and available for public review from August 30, 2004 through September 18, 2004; and WHEREAS, the Planning Commission adopted Resolution No. PC -04-65 recommending City Council to take the following actions: (a) adopt the Initial Study/Mitigated Negative Declaration and mitigation monitoring program, (b) approve General Plan Amendment GP -03-03, and (c) give first reading of the ordinance for rezone R-03-01; and WHEREAS, the Planning Commission also recommended denial of the proposed Final Master Plan and Tentative Tract Map by adopting Resolution No. PC - 04 -66; and PJ WHEREAS, the City Council considered the Planning Commission's recommendations but find that the proposed General Plan Amendment is not consistent with the goals, policies, and objectives of the General Plan and that the project site is not suitable for residential development; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A," the City Council does hereby: (1) deny General Plan Amendment GP -03-03; (2) Rezone R-03-01; (3) Final Master Plan PA -03- 69; (4) Tentative Tract Map T-16302. BE IT FURTHER RESOLVED that the denial of the General Plan Amendment/Rezone/Final Master Plan/Tentative Map constitutes a denial of Planning Application PA -04-40, and no action was taken to adopt the initial study/mitigated negative declaration for the proposed project. The proposed development fails to comply with Costa Mesa Municipal Code Section 13-29 (e) because safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered, however, the quiet enjoyment and compatibility of the proposed residential neighborhood may be adversely affected due to the proximity to the commercial use.
