A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING A VACANCY IN
THE OFFICE OF MEMBER OF THE CITY COUNCIL AND
TO APPOINT A COUNCIL MEMBER TO FILL THE
REMAINDER OF THE TERM OF OFFICE WHICH
EXPIRES IN DECEMBER, 2004.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, Council Member Karen Robinson was appointed by Governor Gray
Davis to the position of Orange County Superior Court Judge, and her official
resignation as Council Member became effective April 15, 2003; and
WHEREAS, California Government Code Section 36512 provides that City
Council has the authority, within thirty (30) days from the commencement of the
vacancy, which date was April 15, 2003, to either fill the vacancy by appointment or call
for a special election to fill the vacancy; and
WHEREAS, the City Council finds that it is in the best interest of the City of
Costa Mesa to fill the vacancy for the un -expired term of Council Member Karen
Robinson (the "former incumbent") by appointing a successor; and
WHEREAS, the City Council published a notice announcing the vacancy and
requested letters of interest from interested residents that are qualified registered voters
of the City, for consideration of appointment to fill the un -expired term of the former
incumbent; and
WHEREAS, the City Council established a deadline of Wednesday, April 16,
2003, for submission of said letters of interest, and by said deadline had received 26
letters of interest and have reviewed the qualified applicants;
WHEREAS, after holding public hearings, taking public comment and reviewing
the qualifications of all of the applicants, the City Council has made a decision
regarding an appointment to fill the former incumbent's vacant council seat.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa does here resolve and declare as follows:
Section 1. That the City Council does hereby appoint Mike Schaefer, an elector
and registered voter of the City of Costa Mesa, to fill the vacancy of Council
Member on the City Council of the City of Costa Mesa for the remainder of the
present term of the former incumbent whose four year term expires in
December, 2004.
PASSED AND ADOPTED this 12t' day of May, 2003.
