A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING MITIGATED
NEGATIVE DECLARATION FOR THE HARBOR
BOULEVARD IMPROVEMENT PROJECT BETWEEN
GISLER AVENUE AND SUNFLOWER AVENUE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES
AS FOLLOWS:
WHEREAS, Draft Initial Study (State Clearinghouse Number 2004111114) has
been prepared for the Harbor Boulevard Improvement Project between Gisler Avenue
and Sunflower Avenue, and
WHEREAS, the Draft Initial Study was prepared in accordance with the
California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City
of Costa Mesa Environmental Guidelines; and
WHEREAS, the City of Costa Mesa circulated the Draft Initial Study from
November 22, 2004, to December 23, 2004, for public comment and review; and
WHEREAS, the City staff conducted a public open house on December 7, 2004,
on the Draft Initial Study; and
WHEREAS, the City of Costa Mesa received written and verbal comments from
the public during and after the review period; and
WHEREAS, written comments and oral testimony were responded to in the
manner set forth in California Code of Regulations Section 15088(b) through
Comments and Responses prepared by the City of Costa Mesa; and
WHEREAS, the City Council conducted a public hearing on February 7, 2005, on
the Draft Initial Study and the recommended Mitigated Negative Declaration; and
WHEREAS, the City Council has reviewed all environmental documents
comprising the Draft Initial Study and the Mitigated Negative Declaration and has found
that the Initial Study considers all environmental impacts of the proposed project, and
the Mitigated Negative Declaration is complete and adequate and fully complies with all
requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa
Environmental Guidelines; and
WHEREAS, the Mitigated Negative Declaration reflects the independent
judgment of the City of Costa Mesa.
NOW THEREFORE, BE IT RESOLVED that the Costa Mesa City Council does
hereby approve the Mitigated Negative Declaration as complete and adequate in that it
addresses all environmental effects on the project and fully complies with the
requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental
Guidelines.
