A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING THE SR-
55/NEWPORT BOULEVARD IMPROVEMENTS PROJECT
BETWEEN 17TH AND 19TH STREETS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES
AS FOLLOWS:
WHEREAS, the SR-55/Newport Boulevard Improvements Project (the "Project")
consists of the addition of a fourth northbound lane from 17m Street to 19"' Street and a
fourth southbound lane from the terminus of the SR -55 through the Newport
Boulevard/19" Street intersection to Broadway. In addition to roadway improvements,
spot sidewalk and curb reconstruction and enhancements, and landscaping and
aesthetic improvements are proposed.
WHEREAS, the Project is consistent with the City of Costa Mesa 2000 General
Plan, and specifically the Master Plan of Highways.
WHEREAS, the Project is consistent with City of Costa Mesa Community
Objective 98-812, which includes analysis of innovative designs to improve traffic flow
in the City's Downtown area.
WHEREAS, the Initial Study/Mitigated Negative Declaration and environmental
review for the Project were processed in accordance with the requirements of the
California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City
of Costa Mesa Environmental Guidelines.
WHEREAS, the Initial Study/Mitigated Negative Declaration was prepared and
identified potentially significant impacts related to aesthetics, hazards and hazardous
material, public services, utilities/service systems, cultural resources, hydrology/water
quality, air quality, geology/soils, land use/planning, and transportation/traffic.
WHEREAS, the Initial Study/Mitigated Negative Declaration identified
appropriate measures to mitigate the identified impacts to a level that is less than
significant.
WHEREAS, the Initial Study/Mitigated Negative Declaration was available for
public review from July 7, 2004 to August 20, 2004.
WHEREAS, the City of Costa Mesa received written and verbal comments from
the public during and after the review period.
WHEREAS, written responses and oral testimony to the comments received on
the Initial Study/Mitigated Negative Declaration were responded to in the manner set
forth in California Code of Regulations Section 15088(b) through Comments and
Responses submitted to the City of Costa Mesa.
WHEREAS, the City Council conducted a public hearing on the Initial
Study/Mitigated Negative Declaration and the Project on July 5, 2005.
WHEREAS, the Initial Study/Mitigated Negative Declaration for the Project
reflects the independent judgment of the City of Costa Mesa.
WHEREAS, the City Council has reviewed all environmental documents
composing the Initial Study/Mitigated Negative Declaration and has found that the Initial

Study/Mitigated Negative declaration considers all environmental impacts of the Project,
and the Initial Study/Mitigated Negative Declaration fully complies with all requirements
of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that the Initial Study/Mitigated Negative Declaration was prepared, pursuant to
the California Environmental Quality Act. According to the Initial Study/Mitigated
Negative Declaration, the proposed Project would not have a significant impact on the
environment with the incorporation of the mitigation measures included in the Initial
Study/Mitigated Negative Declaration. Additionally, the evidence in the record as a
whole indicates that the Project will not or cumulatively have an adverse effect on
wildlife resources or habitat; and
BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find
the Initial Study/Mitigated Negative Declaration fully complies with the requirements of
CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find
that proposed SR-55/Newport Boulevard Improvements Projects will not have a
negative impact on the environment with the incorporation of the mitigation measures
identified in the Initial Study/Mitigated Negative Declaration.
BE IT FINALLY RESOLVED that the Costa Mesa City Council does hereby
approve the SR-55/Newport Boulevard Improvements Project, Initial Study/Mitigated
Negative Declaration, and mitigation monitoring program included as Exhibit "A".
