HomeMy WebLinkAbout05-78 - Certifying that City has Resources to Fund Projects (2005-06 - 2010-11 Transportation Improvement Program)RESOLUTION NO. 05-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CERTIFYING THAT COSTA MESA HAS THE RESOURCES TO FUND THE PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2005-2006 — 2010- 2011 TRANSPORTATION IMPROVEMENT PROGRAM AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED IN THE PROGRAM. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, Costa Mesa desires to include the submitted projects in the Orange County Transportation Authority's (OCTA) Regional Transportation Improvement Program; and WHEREAS, Costa Mesa warrants that full funding is committed and available for projects submitted for programming in the first three years (FY 2005-06, 2006-07, 2007- 08) of the Regional Transportation Improvement Program; and that Costa Mesa accepts responsibility for full funding of said projects and warrants that no additional funding allocations are required of OCTA for Costa Mesa to fully implement said projects therefore committing that the first three years of the RTIP are financially constrained; and WHEREAS, projects programmed in years 2008-09 — 2010-11 are projects expected to receive future funding through anticipated revenues, therefore all projects submitted for inclusion in the 2006 RTIP are financially constrained; and WHEREAS, OCTA as the agency responsible for short-range capital and service planning and programming for the Orange County Area, requires an approved resolution from the governing body of the Lead Agency for all projects included in the Transportation Improvement Program; and WHEREAS, OCTA also requires that the Lead Agency include a financial plan that demonstrates how the projects submitted for inclusion in the Transportation Improvement Program can be implemented; and WHEREAS, the City of Costa Mesa, as the Lead Agency, possess the legal authority to submit the project for inclusion in the Transportation Improvement Program and to finance, acquire, and construct the project; NOW, THEREFORE, BE IT RESOLVED that the City Council of Costa Mesa does hereby: Affirm its continuing commitment to the projects submitted for inclusion in the 2006 Regional Transportation Improvement Program; and Commit that the city of Costa Mesa, as Lead Agency for the projects, will carry out the projects consistent with the project implementation schedule; and Certify that the City of Costa Mesa will enter into a contract with OCTA committing that it will carry out the projects identified as transportation control measures (TCM) in the South Coast Air Basin consistent with the project implementation schedule; and Certify that the City of Costa Mesa will allocate the necessary local match funds contained within the project to carry out any federally approved project; and Certify that the City of Costa Mesa, as the lead agency, will comply with applicable provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, the Secretary of the Interior's Standards and Guidelines for Archaeology and Historic Preservation, and any other Federal, State, and/or local laws, rules and regulations. 2 PASSED AND ADOPTED this 1" day of November, 2005.
