ADOPTION OF AN ORDINANCE TO AMEND ARTICLE 11 1/2 OF CHAPTER II OF TITLE 9 OF THE COSTA MESA MUNICIPAL CODE RELATING TO SPECIAL EVENT REGULATIONS Action: City Council adopted Ordinance No. 19-17, amending Article 11 '/2 (Regulatory Permits for Special Events) of Chapter II (Regulation of Certain Businesses) of Title 9 (Licenses and Business Regulations) of the Costa Mesa Municipal Code. 5. APPROVAL OF PROFESSIONAL SERVICES AGREEMENT WITH THIRDWAVE CORPORATION FOR ENTERPRISE RESOURCE PLANNING (ERP) SYSTEM PROCUREMENT SERVICES Action: 1. City Council approved a budget adjustment appropriating $132,000 from committed fund balance in the Information Technology Replacement Fund to the Enterprise Resource Planning (ERP) System Upgrade project for procurement of an ERP system; and 2. Approved and authorized the City Manager to sign the Justification for Single Source Request for Thirdwave Corporation for ERP system procurement services; and 3. Approved the proposed Professional Services Agreement (PSA) with ThirdWave Corporation for ERP system procurement services for a total not -to -exceed amount of $120,000 for a five-year term, ending September 30, 2024; and 4. Authorized a ten (10) percent contingency, if needed; and 5. Authorized the City Manager and City Clerk to execute the proposed PSA and future amendments to the agreement within Council authorized limits. 7. AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT WITH BLACK, O'DOWD AND ASSOCIATES, INC. DBA BOA ARCHITECTURE FOR ARCHITECTURAL AND ENGINEERING SERVICES FOR THE FINANCE DEPARTMENT SECURITY AND EFFICIENCY RECONFIGURATION PROJECT Action: 1. City Council approved proposed Amendment No. 1 to the Professional Services Agreement (PSA) with Black, O'Dowd and Associates, Inc. dba BOA Architecture for architectural and engineering services for the Finance Department Security and Efficiency Reconfiguration Project, increasing the compensation by $60,600, for a total not -to -exceed amount of $75,900; and 2. Authorized a ten (10) percent contingency, if needed; and 3. Authorized the City Manager and City Clerk to execute the proposed amendment and future amendments to the agreement within Council authorized limits. FOR PROFESSIONAL ENGINEERING SERVICES FOR THE PUBLIC SERVICES DEPARTMENT, ENGINEERING AND TRANSPORTATION SERVICES DIVISIONS Action: 1. City Council approved proposed Amendment No. 3 to the Professional Services Agreement (PSA) with Interwest Consulting Group Inc., 15140 Transistor Lane, Huntington Beach, CA 92649, increasing the compensation by $200,000, for a total not -to -exceed amount of $534,000; and 2. Authorized the City Manager and the City Clerk to execute the proposed Amendment and future authorized amendments to the agreement. ITEMS PULLED FROM THE CONSENT CALENDAR: 6. APPROVAL OF RETAINER AGREEMENT FOR LEGAL SERVICES WITH HAYNES AND BOONE, LLC (01:16:15) Presentation by Ms. Hall Barlow, City Attorney Discussion ensued on the budget and authorization for the City Manager for litigation above 1.5 million. Public Comments: Ralph Taboada, Costa Mesa, expressed concerns on recommendation number 4, using unassigned fund balance/reserves for spending 1.5 million, and on the litigation budget being prepared before approval. Mayor Foley motioned to approve the recommended action with the following change: a written budget shall be provided to Council and when the expenditures reach $250,000.00 a report must come back to Council. Mayor Foley spoke on the City having to respond to the Appeal. Minutes — Regular Meeting - October 1, 2019 — Page 7 Mayor Pro Tern Stephens spoke to supporting the motion and spoke in support of the firm. Council Member Genis spoke on unexpected legal fees and exceeding budgeted amounts, and spoke on adequately funding expenses in the budget. Council Member Marr spoke in support of a report coming back to the Council when the $250,000.00 limit is reached. Ms. Farrell Harrison, City Manager suggested to remove item number 4 from the recommendation and if the amount rises above 1.5 million, staff will bring back to Council; and recommended keeping the $250,000.00 threshold on the case. Mayor Foley and Mayor Pro Tem Stephens agreed to the changes. Council Member Reynolds requested regular updates on attorney fees/costs. Approved the proposed Retainer Agreement with Haynes and Boone, LLP for legal services in connection with anticipated appeal proceedings in Yellowstone Women's First Step, Inc. et al. v. City of Costa Mesa, United State District Court Case No. 8:14-CV-01852-JVS-JDE; and 3. A RESOLUTION AMENDING AND ADOPTING THE CITY'S SMALL CELL TELECOMMUNICATION FACILITY DESIGN GUIDELINES (02:18:35) Staff presentation by Ms. Le, Assistant Director of Development Services. Ms. Hall Barlow, City Attorney, spoke on regulations pertaining to RF emissions and regulations that limit local authority. Minutes — Regular Meeting - October 1, 2019 — Page 10 Discussion ensued on requirements, previous court cases on City regulations, state law guidelines, setbacks, 500' noticing, testing and cost, and aesthetics. Public Comments: Bryan Estrada, Costa Mesa, expressed concern over the design guidelines and public review limitations. (03:21:13) Becca Walls, Costa Mesa, thanked Council for reviewing the item. Spoke on the proximity to schools, aesthetics in neighborhoods, third party testing, and requested proof that 5G is needed. (04:00:27) MOVED/SECOND: Mayor Pro Tern Stephens/Council Member Marr MOTION: Approve recommended actions with the following changes: No blocking of any public art or historical buildings; add the landscaping language to section 2d; staff to include in an Ordinance how to address non -compliant facilities after installed; and add noticing for 500' instead of 100'. Council Member Marr requested to add to the motion, if there is a significant change to require an encroachment permit with 500' noticing requirement, online map and administerial decisions will be posted online, post installation measurement report for all facilities installed, identify full cost reimbursement as part of fees for carriers, incorporate provision for decommissioning facilities, pole replacement shall prioritize ADA access, and landscaping shall not to be replaced by concrete in order to accommodate cell sites. Mayor Pro Tern Stephens agreed to the changes in the motion. Discussion ensued on public input, carriers sharing towers/poles, ADA compliance, aesthetics, property lines, limiting the days to receive applications, noticing requirements, and post installation testing and cost. Mayor Pro Tern Stephens, added to his motion 250' separation between cell sites unless the provider can show that meeting that separation distance would effectively prohibit wireless service. Council Member Marr withdrew the second. Council Member Chavez seconded the motion.
