The Closed Session was called to order by Mayor Foley at 4:00 p.m. in the Council
Chambers at Costa Mesa City Hall, 77 Fair Drive, Costa Mesa, California

Speaker, spoke on the public being able to make comments on an item on the next
Planning Commission meeting agenda and requested the item to be postponed.

Speaker, spoke on starting the meetings on time and clarified what items are considered
essential, requested the homeless shelter costs, and spoke on an item being placed on

COUNCIL MEMBER COMMITTEE REPORTS, COMMENTS, AND SUGGESTIONS

Council Member Genis thanked staff for their work during the difficult time, thanked
grocery store workers, suggested donating to food pantries and storing food properly,
and spoke on civil liberties. (00:13:12)
Council Member Reynolds thanked City Hall staff for extra work being done during
difficult times, spoke on the importance to stay home, and to communicate with City
Council any needs. (00:16:30)
Council Member Chavez commended everyone for staying home and doing their part,
and encouraged anyone needing anything to reach out to City Council and staff.

Mayor Pro Tern Stephens spoke on the homeless shelter and the difficult times being

Ms. Farrell Harrison highlighted steps that the city is taking to protect the residents from
COVID-19 and encouraged staying up to date on any changes by checking the city
website regularly.

ACTION:
City Council approved Warrant Resolution No. 2637 of the City Council of the City
of Costa Mesa, California, allowing certain claims and demands, including Payroll
Register Nos. 20-04 "A" for $698.09 and 20-05 for $2,636,418.85; and City
operating expenses for $2,743,624.56.
4. MINUTES OF THE REGULAR CITY COUNCIL AND SUCCESSOR AGENCY TO
THE REDEVELOPMENT AGENCY MEETINGS OF JULY 2, 2019, JULY 16, 2019,
AND AUGUST 6, 2019
ACTION:
City Council approved the minutes of July 2, 2019, July 16, 2019, and August 6,
2019.
6. ADOPTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA AMENDING CHAPTER V (FINANCE) OF TITLE 2
(ADMINISTRATION) OF THE COSTA MESA MUNICIPAL CODE TO REVISE
ARTICLE 8 (CAPITAL ASSET NEEDS) AND ADD ARTICLE 9 (INFORMATION
TECHNOLOGY NEEDS), RELATING TO ANNUAL GENERAL FUND
ALLOCATIONS FOR CAPITAL ASSET AND INFORMATION TECHNOLOGY
NEEDS
ACTION:
City Council adopted Ordinance No. 2020-06, amending Chapter V (Finance) of Title
2 (Administration) of the Costa Mesa Municipal Code to revise Article 8 (Capital Asset
Needs) and add Article 9 (Information Technology Needs), relating to annual general
fund allocations for capital asset and information technology needs.

7. AMENDMENT NO. 3 TO PROFESSIONAL SERVICES AGREEMENT WITH MV
CHENG & ASSOCIATES FOR TEMPORARY STAFF SUPPORT SERVICES IN
THE FINANCE DEPARTMENT
ACTION:
1. City Council approved the proposed Amendment No. 3 to the Professional
Services Agreement (PSA) with MV Cheng & Associates, Inc. to increase the
PSA by $50,000, for a total not -to -exceed amount of $249,999 for temporary staff
support services in the Finance Department; and
2. Authorized the City Manager and City Clerk to execute the proposed amendment
and future amendments to the PSA within Council authorized limits.

5. ADOPTION OF AN ORDINANCE PROVIDING FOR A REDUCTION OF THE

Mayor Foley recused herself and stepped down from the dais for this item as she
has a conflict regarding donations received.
Discussion ensued on permanently changing the tax rate.

Steve Hellings, SW Ventures, spoke on not changing the recommended action.

Ms. Green, City Clerk, read into the record a letter from Ralph Taboada expressing
concern over the tax being a permanent change. (00:40:22)
MOVED/SECOND: Mayor Pro Tern Stephens/Council Member Reynolds
MOTION: Approve the ordinance including the 1 % tax and include language that
City Council can, on a majority vote increase the tax up to 6%.
Mayor Pro Tern Stephens spoke on the motion.
Council Member Reynolds withdrew the second.

City Council adopted Ordinance No. 2020-05, providing for a reduction of the
business tax set forth in Article 5 (Administration) of Chapter I (Business Tax) of the
Costa Mesa Municipal Code as authorized by Measure X, the Costa Mesa Medical
Marijuana Measure, as amended, that is levied upon the lawful distribution,
manufacturing, testing, and/or research and development of marijuana.

ACTION:
City Council received and filed the 2020 Census Strategic Plan and provided input
on additional methods to increase participation in order to ensure Costa Mesa
receives its fair share of Federal and State resources.
Ms. Hall Barlow announced that the California Public Utilities Commission issued an order
determining that there will be no customer disconnections for nonpayment for energy,
water, sewer, and communications companies due to Covid-19 circumstances.
2. INTRODUCE FOR FIRST READING AN ORDINANCE AMENDING CHAPTER I
(IN GENERAL) OF TITLE 6 (DISASTER RELIEF AND CIVIL DEFENSE) OF THE
COSTA MESA MUNICIPAL CODE RELATING TO EMERGENCY
PREPAREDNESS, ORGANIZATION AND COORDINATION (01:20:11)
Staff presentation by Mr. Dempsey, Emergency Services Administrator.
Discussion ensued on the structure and role of the Disaster Council membership.
Public Comment:
Ms. Green, City Clerk, read a public comment into the record asking if Costa Mesa
is in a shelter in place situation. (01:34:23)

MOTION: Approve first reading of the ordinance with the following changes:
include the mayor or the mayors designee as an ex -off icio member of the Disaster
Council, the Chair is the Director of Emergency Services, and the Assistant Chair
is the Assistant Director of Emergency Services and everything else will remain
the same.
