HomeMy WebLinkAbout06-36 - Adopting Prequalification Program; Public Contract Code Sec 10163 for Construction of Police Facilityr RESOLUTION NO. 06-,_L6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING A PREQUALIFICATION PROGRAM INCLUDING PREQUALIFICATION STATEMENT, UNIFORM SYSTEM OF RATING, AND APPEAL PROCEDURE PURSUANT TO PUBLIC CONTRACT CODE SECTION 10163 FOR CONSTRUCTION OF THE POLICE FACILITY EXPANSION AND RENOVATION PROJECT THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa ("City") desires to prequalify potential bidders for the City's Police Facility Expansion and Renovation Project; and WHEREAS, Public Contract Code section 20101 authorizes the City to require prospective bidders to submit a standardized questionnaire and financial statement prior to bidding on specific construction projects; and WHEREAS, City staff has developed a standardized questionnaire and request for financial statement in accordance with Public Contract Code section 20101 (collectively "Statement"). A copy of the Statement is attached hereto as Exhibit "A" and incorporated herein; and WHEREAS, Public Contract Code section 20101 also requires the City to adopt a uniform system of rating bidders based upon the basis of the completed Statements; and WHEREAS, City staff has developed an evaluation procedure for the purpose of applying a uniform system of rating potential bidders based upon the basis of the completed Statements ("Rating System"). A copy of the Rating System is attached hereto as Exhibit "B" and incorporated herein; and WHEREAS, the Statement includes a process for potential bidders to appeal certain decisions with respect to the prequalification process ("Appeal Process"); and WHEREAS, the City desires to adopt the Statement, the Rating System, and the Appeal Process (collectively, the "Prequalification Program"); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS; 1. That the above recitals are true and correct. 2. That the Prequalification Program is approved and adopted pursuant to Public Contract Code section 20101. 3. That the Director of Public Services, or his designee, is authorized to implement a prequalification process for the Project consistent with the Prequalification Program and Public Contract Code section 20101. 4. This first step will be open to all licensed general contractors who wish to be considered for Prequalification. Step Two of this process (submission of the bid) will be restricted to only those general contractors who are determined by the Agency to be prequalified as a result of this process. General contractors who are interested in prequalifying for this project and want to obtain a Prequalification Packet should call, Ms. Irina Gurovich of the City at (714) 754-5324. After receipt of the Prequalification Packet, specific questions should be directed in writing to the City's Construction Manager, Harris & Associates, Mr. Jim Guerrero at (949) 655-3900, or fax at (949) 655-3995. 2.0 DATE OF SUBMITTAL Contractor Prequalification Statements will be available _starting April 19, 2006, and must be returned in a sealed envelope to the. City Clerk's office prior to 5:00 P.M. on Thursday, -May 18, 2006. No prequalification documents will be accepted after this time. However, the Agency reserves the right to request, receive and evaluate supplemental information from contractors and other sources/references as is deemed necessary to properly evaluate their qualifications. Contractor Prequalification Statements shall be submitted in sealed envelopes marked on the outside, "CONTRACTOR PREQUALIFICATION STATEMENT, COSTA MESA POLICE FACILITY EXPANSION AND RENOVATION". 3.0 PREQUALIFICATION JOB WALK On Thursday, May 4, 2006 at 2:00 P.M., a non -mandatory Prequalification Job Walk will be conducted for all interested general contractors at 99 Fair Drive, Costa Mesa, CA. Bidders will be afforded an opportunity to review existing conditions and the proposed construction and staging areas. 4.0 LOCATION OF PROJECT The project is located at 99 Fair Drive, Costa Mesa, California. CITY OF COSTA MESA 2 of 7 COSTA MESA POLICE FACILITY EXPANSION AND RENOVATION PROJECT 5.0 PROJECT DESCRIPTION The Police Facility located at 99 Fair Drive, was built in the 1960's and is approximately 45,143 square feet in area. Due to the increase in size of the City and the Police staff, the need to expand has become a reality. The first phase of the project includes the construction of a new 11,000 square foot building adjacent to the existing building. The existing building itself is planned for renovation, which will be performed as the second phase of the project. The entire project is estimated at approximately $19.1 million. Construction is estimated to take 24 months. Construction is intended to proceed in a phased manner, ng facilities to remain in place and occupied until replacement facilities are ittinconstructed mostsand put into use. It is anticipated that the temporary, on-site relocation of some facilities will be necessary as part of this project. This will include temporary office facilities, lockers, showers, and changing -room facilities during the existing building renovation. The contractor will have the responsibility to comply with the project phasing and the temporary relocation plan to minimize the impact on project schedule, and to reduce the disruption to on-going City operations. costs and the project 6.0 CONTRACTOR PREQUALIFICATION PROCEDURES 6.1 Contractor Prequalification Packets will be available at the offices of the: City of Costa Mesa Public Services Department, 77 Fair Drive, 4t' Floor, Costa Mesa, California 92626. The Prequalification Packet can be mailed (faxes not provided) to prospective bidders unable to obtain them in person by calling Ms. Irina Gurovich at (714) 754-5329, or by faxing your request to (714) 754-5028 provided requests are received no later than May 12, 2006. 6.2 This evaluation process (Step One) is solely for the purpose of determining which potential bidders are deemed qualified to provide successful performance on the type of work included in the Police Facility. The City shall competitively determine the. low Bidder from the pool of prequalified general contractors bidding the work on the basis of the lowest responsive and responsible Lump Sum Base Bid (Step Two). N= Simply being pre- qualified does not imply that the City has determined that the bidder is responsive and/or responsible. 6.3 The City reserves the right, after reviewing the Prequalification Statements, to reject any and all Statements, to waive any informality in the Statements and to invite those qualified general contractors to submit bids for the project once it is advertised. CITY OF COSTA MESA COSTA MESA POLICE FACILITY EXPANSION 3 of 7 AND RENOVATION PROJECT 4" 6.4 Contractors that have submitted Statements for review shall receive written notification of their prequalification status. The City reserves the right to reject any or all Statements or to waive irregularities in any Statements received. 6.5 Nonresponsiveness. A Contractor's. Statement shall be deemed nonresponsive if: 6.5.1 The Statement is not returned on time. 6.5.2 Contractor does not provide all requested information. 6.5.3 The Statement is not signed under penalty of perjury by individuals who have the authority to bind the Contractor on whose behalf they are signing. 6.5.4 Information contained in the Statement is not updated under penalty of perjury when it is no longer accurate. 6.5.5 Any information provided by the Contractor is misleading or inaccurate in any material manner (e.g., financial resources are overstated; previous violations of law are not accurately reported). Even after a Contractor has been determined to be qualified, the City reserves the right to revoke that determination at any subsequent time, to terminate any contract awarded, and to cease making payments if it determines that any information provided by the Contractor was incomplete, misleading, or inaccurate in any material manner. 6.6 All information submitted for prequalification evaluation will be considered public information and the City will maintain its confidentiality to the extent permitted by law. 6.7 Prequalification of a prospective general contractor will be determined by responses to the following information to be submitted by the bidders. Prospective general contractors will be considered eligible to participate in Step Two of the bid process (bid submittal), only if ALL of the following criteria applies: (a) Have a valid class B General -Contractor's license in good standing, and have never had any license revoked by the State of California Contractor's License Board; and (b) Have not had a Surety or Bonding company finish work on any contract. And Are able to substantiate currently available bonding capacity in excess of $19,000,000 (Nineteen Million Dollars); and (c) Are able to obtain the required insurance, as identified in Sections 2.0 and 3.0 of the Prequalification Statement; and CITY OF COSTA MESA 4 of 7 COSTA MESA POLICE FACILITY EXPANSION AND RENOVATION PROJECT •' (d) Contractor to provide evidence meeting the requirements for surety insurance requirements in Attachment D. (e) The Contractor by submitting prequalification documents agrees that they will be bound by the indemnity language included in Attachment D, which will be incorporated into the final agreement. (f) Have complete, since construction projects, $19,000,000 (Nineteen following criteria: January 1, 1996, at least each having an in-place Million Dollars) and which three 3 building value of at least satisfy all of the (1) At least one (1) of the projects must have involved the construction of a steel -framed building with hard and soft landscaping element; and (2) At least one (1) of the projects must have been a publicly -bid or prevailing wage (Davis -Bacon) contract of an institutional building constructed for a public client (such as a City, County or Public University); and (3) All projects must have been built of Construction Type I, II or III One Hour or Fire Resistive Construction (as defined by the Uniform Building Code), that is, consisting of structural steel, and/or concrete structural framing; and (4) All projects must have been constructed in California, and (g) Currently working on at least three 3 building construction projects, each having an in-place value of at least $10,000,000 (Ten Million Dollars) and which satisfy the following criteria: (1) At least one (1) of the projects must be a publicly -bid or prevailing wage (Davis -Bacon) contract of an institutional building constructed for a public client (such as a City, County or Public University); and (2) All projects must be within California, and (h) Proposed Superintendent has acted as superintendent on at least one (1) project following the same criteria outline in g. and/or h. above, which must have been completed for the prospective Contractor and Proposed Project Manager has acted as project manager on at least one (1) project following the same criteria outlined in g. and/or h. above, which must have been completed for the prospective Contractor; and (i) Have not had three (3) or more claims (including demands for Liquidated Damages) in excess of $50,000 (Fifty Thousand Dollars) filed against CITY OF COSTA MESA COSTA MESA POLICE FACILITY EXPANSION 5 of 7 AND RENOVATION PROJECT AIC them since January 1, 1996 by Owners for: (1) poor workmanship/incomplete performance, or (2) unexcused delays in completion, which were resolved with the result that bidder, its surety or insurer was required to make a payment to the Owner or was assessed a deduction in the contract price by Owner in an amount equal to or exceeding fifty Percent (50%) of the amount claimed by Owner or (3) termination by Owner for nonperformance; and (j) Have not asserted three (3) or more claims in excess of $50,000 (Fifty Thousand Dollars) for extra compensation against Owners since January 1, 1996 which were resolved with the result that bidder, its Surety or insurer failed to receive a recovery or settlement in an amount equal to or exceeding fifty percent (50%) of the amount claimed by bidder; and (k) Are presently not disqualified from performing work for any public Owner or contracting entity; and (1) Neither the firm not its officers have been assessed any penalties by any agency for non-compliance violations of Federal or State labor laws and/or business or licensing regulations relating to construction projects since January 1, 2001. 6.6 For informational purposes only, the general contractor shall provide the following: (a) Provide a copy of the Contractor's current audited Financial Statement; and (b) Provide a notarized statement from Worker's Compensation carrier specifying bidder's current Experience Modification Rate, as required in Section 12.0 of the Prequalification Statement.; and (c) Provided a complete listing of all Owners contracted with on all projects with a value of $19,000,000 (Nineteen Million Dollars) or more undertaken since January 1, 1996. The successful general contractor and major subcontractors may be required to participate in a 'Partnering" workshop to be conducted by the City, and involving the City, Architect and Construction Manager. 7.0 EVALUATION OF STATEMENTS As stated above, each Contractor must satisfy all of the criteria, regardless of its ranking or ability to meet other criteria, or the Contractor will not prequalify for the Police Facility Project. The Statement contains questions for which a numerical score will be given. for specific answer(s). A Contractor must receive a minimum number of CITY OF COSTA MESA 6 of 7 COSTA MESA POLICE FACILITY EXPANSION AND RENOVATION PROJECT -0 - points, points, regardless of its ability to meet other criteria, or the Contractor will not prequalify for the Police Facility Project. Even if a Contractor satisfies all of the criteria, and receives at least the minimum number of points, the City reserves the right to disqualify it from bidding on other grounds. 8.0 APPEALING A QUALIFICATION FINDING Contractor shall adhere to these procedures and timelines. Without a proper and timely appeal, the Contractor waives any and all rights to challenge the decision of the City, whether by administrative process, judicial process, or any other legal process or proceeding. These procedures are ann opportunity for Contractor to present evidence to the City supporting contractor's contention that Contractor meets the City's qualification criteria. Step One: Contractor may appeal the City's decision by submitting, in writing, within three (3) working days from notification, a request for a meeting with the City Engineer. Contractor may submit with the request any information that it believes supports a finding that the City's determination should be changed. After the Contractor's meeting with the City Engineer, the City Engineer will provide the Contractor with a written statement in response to that meeting. Step Two: Within three (3) working days of Contractor's receipt of written statement from the City Engineer, the Contractor may submit, in writing, a request for a meeting with the Director of Public Services. After the Contractor's meeting with the City's Director of Public Services, The Director of Public Services will provide the Contractor with a written statement in response to that meeting. The statement from the Director of Public . Services shall be the final decision of the City. Unless previously provided by CONTRACTOR to CITY, CONTRACTOR shall fiirnish, concurrently with the execution of this Agreement, the following: (1) a surety bond in an amount equal to one hundred percent (100%) of the contract price as security for the faithful performance of this Agreement, and (2) a separate surety bond in an amount equal to at least one hundred percent (100%) of the contract price as security for the payment of all persons furnishing labor or materials in coruiection with the Work under this Agreement. Sureties for each of the bonds and the forms thereof shall be satisfactory to CITY. In addition, such sureties must be authorized to issue bonds in California; sureties must be listed on the latest revision to the U.S. Department of the Treasury Circular 570; and must be shown to have sufficient bonding capacity to provide the bonds required by the Contract Documents. CONTRACTOR shall provide a certified copy of the certificate of authority of the surety issued iby the Insurance Commissioner; a certificate from the clerk of the county in which the court or officer is located that the certificate of authority of the surety has not been surrendered, revoked, canceled, annulled, or suspended or, in the event that it has, that renewed authority has been granted; and copies of the surety's most recent annual statement and quarterly statement filed with the Department of Insurance pursuant to Article 10 (commencing with Section 900) of Chapter 1 of Part 2 of Division 1 of the Insurance Code. CONTRACTOR guarantees that all materials used in the Work and all labor performed shall be in conformity with the Contract Documents including, but not limited to, the standards and specifications set forth in the most current edition of Standard Specifications for Public Works Construction, published by Building News, Inc., Los Angeles, California, more commonly known as "The Green Book." CONTRACTOR shall, at his own expense, make any and all repairs and replacements that shall become necessary as the result of any failure of the Work to conform to the aforementioned Contract Documents, and CITY OF COSTA MESA PREQUALIFICATION STATEMENT 17 of 21 POLICE FACILITY EXPANSION AND RENVOATION PROJECT standard specifications; provided, ho« -ever, that CONTRACTOR shall be obligated under- this provision only to the extent of those failures or defects of which he is given notice within a period of twelve (12) months frorn the date that the Notice of Completion is recorded. The rights and remedies available to CITY pursuant to this provision shall be cumulative with all rights and remedies available to CITY pursuant to statutory and common law, which rights and remedies are hereby expressly reserved, and neither the foregoing guarantee by CONTRACTOR nor his furnishing of the Bonds, nor acceptance thereof by CITY, shall constitute a waiver of any rights or remedies available to CITY against CONTRACTOR. INDEMNIFICATION. CONTRACTOR agrees to protect, defend, indemnify and hold hannless CITY and its elected and appointed boards, officers, agents, and employees fiorn any and all claims, liabilities, expenses, or damages of any nature, including attorney fees, for injury to or death of any person, and for injury or damage to any property, including consequential damages of any nature resulting therefrom, arising out of or in any way connected with the performance of this Agreement, except that the indemnity obligation of CONTRACTOR shall be reduced by an amount proportional to the active negligence of CITY, if any. CONTRACTOR shall comply with all of the provisions of the Workers' Compensation insurance laws and Safety in Employment laws of the State of Califoriia, including the applicable provisions of Divisions 4 and 5 of the California Labor Code and all amendments thereto and regulations promulgated pursuant thereto, and all similar State, Federal or local laws applicable; and CONTRACTOR shall indemnify and hold harmless CITY from and against all claims, liabilities, expenses, damages, suits, actions, proceedings and judgments, of every nature and description, including attorney fees, that may be presented, brought or recovered against CITY for or on account of any liability under or failure to comply with any of said laws which may be incurred by reason of any Work performed under this Agreement by CONTRACTOR or any subcontractor or others performing on behalf of CONTRACTOR. CITY OF COSTA MESA PREQUALIFICATION STATEMENT 18 of 21 POLICE FACILITY EXPANSION AND.RENVOATION PROJECT CITY does not, and shall not, waive any rights against CONTRACTOR wluch it may have by reason of the above hold hannless agreements, because of the acceptance by CITY or the deposit with CITY by CONTRACTOR of any or all of the insurance policies described in Paragraph 19 of this Agreement. The hold harmless agreements by CONTRACTOR shall apply to all liabilities, expenses, claims, and damages of every kind (including but not limited to attorney fees) incurred or alleged to have. been incurred, by reason of the operations of CONTRACTOR or any subcontractor or others performing on behalf of CONTRACTOR, whether or not such insurance policies are applicable. CONTRACTOR shall require any and all tiers of subcontractors to afford the same degree of indemnification to the CITY OF COSTA MESA and its elected and appointed boards, officers, agents, and employees that is required of CONTRACTOR and shall incorporate identical indemnity provisions in all contracts between CONTRACTOR and all tiers of his subcontractors. In the event that CONTRACTOR and CITY are sued by a third party for damages caused or allegedly caused by negligent or other wrongful conduct of CONTRACTOR, or by a dangerous condition of CITY'S property created by CONTRACTOR or existing while the property was under the control of CONTRACTOR, CONTRACTOR shall not be relieved of its indemnity obligation to CITY by any settlement with any such third party unless that settlement includes a full release and dismissal of all claims by the third party against the CITY. INSURANCE. CONTRACTOR shall not commence Work under this Agreement until he has obtained all insurance required under this section and CITY has approved the insurance as to form, amount, and carrier, nor shall CONTRACTOR allow any subcontractor to commence any Work until all similar insurance required of the subcontractor has been obtained and approved. Neither the failure of CONTRACTOR to supply specified insurance policies and coverage, nor the failure of CITY to approve same shall alter or invalidate the provisions of Paragraph 18 of this CITY OF COSTA MESA PREQUALIFICATION STATEMENT 19 of 21 POLICE FACILITY EXPANSION AND RENVOATION PROJECT Agreement. A. Workers' Compensation Insurance. CONTRACTOR shall obtain and maintain during the life of this Agreement workers' compensation insurance and, if any Work is sublet, CONTRACTOR shall require all tiers of subcontractors to obtain workers' compensation insurance. All workers' compensation insurance policies shall provide that the insurance may not be canceled without thirty (30) days' advance written notice of such cancellation to CITY. B. Liability Insurance Coverage. CONTRACTOR shall obtain and maintain during the life of this Agreement the following insurance coverage: (1) Comprehensive General Liability, including coverage for premises -operations, products/completed operations hazard, blanket contractual, broad form property damage, and independent contractors. In addition, CONTRACTOR shall obtain and maintain during the life of this Agreement each of the following insurance coverage which are not stricken out and initialed by the Project Manager: Explosion and collapse hazard, underground hazard; personal injury, and automobile liability, including owned, hired, and non -owned vehicles. All insurance coverage shall have limits of not less than $4,000,000.00 combined single limit, per occurrence and aggregate. (2) Endorsements to the policies providing the above insurance shall be obtained by CONTRACTOR, adding the following three provisions: (i) Additional Insured: "The CITY OF COSTA MESA and its elected and appointed boards, officers, agents, and employees are additional insured with respect to the subject Project and Agreement."
