SPECIAL JOINT STUDY SESSION OF THE
CITY OF COSTA MESA
CITY COUNCIL
AND THE
PLANNING COMMISSION
July 14, 2009
The City Council of the City of Costa Mesa, California met in a Special Joint Study
Session with the Planning Commission, on Tuesday, July 14, 2009, at 4:35 p.m. in the
Conference Room 1A of City Hall, 77 Fair Drive, Costa Mesa. The meeting was called
to order by the Mayor.

III. PUBLIC COMMENT
1. John Holly, Westside business owner, encouraged the Council to
develop a proper live-work plan that is innovative and offers the
necessary parking and medium density.
2. Eleanor Egan, Costa Mesa, recalled the extensive work and public
input that went into the development of the Urban Plans and
recommended that the plan be given an opportunity to work and
should not be amended so quickly.
3. Chris McEvoy, Costa Mesa, encouraged patience when reviewing
projects or making changes to the plans to stimulate development on
the Westside at the expense of the vision. He presented a petition of
signatures that were collected to discourage overdevelopment of the
Westside.
4. Martin Millard, Costa Mesa, felt it was time to create incentives for
the development on the Westside and of the bluffs.
5. Theresa Bamwell, Costa Mesa, cautioned against over development
on the Westside and of higher density as well as informing of the need
to be more aware of bordering projects and/or determinations made by
the City of Newport Beach and of the negative impacts on the quality of
life for the Westside of Costa Mesa.
IV. ITEMS FOR DISCUSSION
1. Report on Existing City Regulations for Establishments that Sell Alcoholic
Beverages for Off-site Consumption and Alternatives for Additional
Regulations.
Planning Administrator Claire Flynn introduced Bryan Rushing, Investigator,
and Department of Alcohol Beverage Control, who presented reports on
options to consider for regulating existing off-sale Alcoholic Beverage Control
(ABC) License for establishments that are operating without a Conditional
Use Permit (CUP) and of the current enforcement processes by the
Department of ABC. Questions from the Council and the Planning
Commission that were responded to included the bringing into compliance
those establishments without a CUP, public nuisances, targeted enforcement,
citywide regulations, restriction on the number of licenses, and the limiting of
hours for the sale of alcohol. No action was taken on this item.
2. Code Enforcement Priorities and Procedures for Issuing Notices of Violations
and Citations.
Acting Development Services Director Kimberly Brandt and Chief of Code
Enforcement Willa Colleen-Bowens presented the annual report on those
priorities that the Code Enforcement had focused on throughout the past year,
outlined the civil citation process, noted personnel rotations and of the newly
adopted Shopping Cart Containment Ordinance. They responded to questions
from the Council and the Planning Commissioners relative to locks on
dumpsters, screening of dumpsters, civil citation procedures, banners, problem
properties, fences, fines, and progressive discipline. Discussions ensued with
staff relative to code enforcement priorities for that of the Council and of the
Planning Commission for the coming year.
3. SoBECA Plan/19 West/ Mesa West Bluffs Urban Plans—Discussion of
expanding the types of"Permitted Uses" in the Underlying Zoning Districts.
Planning Administrator Claire Flynn summarized the staff report relative to
suggestions in expanding the "permitted uses" within the urban planned areas
noting that the approved projects are progressing slowly or at a stand still due to
the economic conditions. Discussion ensued regarding minor conditional use
permits, parking, incentives for green building and LEAD certification. No action
was taken.
V. CITY COUNCIL AND PLANNING COMMISSION COMMENTS
Priorities and general direction was discussed between the Council and the Planning
Commission that included, review of environmental related laws, such as Senate Bill
SB375, and Assembly Bill AB32, award programs to acknowledge innovative and
green buildings, code enforcement, the appeals of Planning Commission
determinations, liquor stores, and the Urban Plans.
VI. ADJOURNMENT:
The Mayor declared the City Council meeting adjourned at 7:10 p.m. The next
Regular Meeting will be held on July 21, 2009, at 6:00 p.m.
