HomeMy WebLinkAbout13-40 - Single Family Rehab Loan and Grant ProgramRESOLUTION NO. 13-40 A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA AND THE COSTA MESA HOUSING AUTHORITY DIRECTING THE CITY'S CEO AND THE CMHA EXECUTIVE DIRECTOR TO MODIFY A CERTAIN POLICY OF THE CITY OF COSTA MESA SINGLE FAMILY REHABILITATION LOAN AND GRANT PROGRAM POLICIES, PROCEDURES AND GUIDELINES RELATED TO INCREASING GRANT AMOUNTS FOR SINGLE FAMILY HOMES AND MOBILE HOMES (HOME PROGRAM) THE CITY COUNCIL OF THE CITY OF COSTA MESA AND THE COSTA MESA HOUSING AUTHORITY DO HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa and the former Costa Mesa Redevelopment Agency ("former RDA") previously established, jointly funded, and administered the COSTA MESA SINGLE FAMILY REHABILITATION LOAN AND GRANT PROGRAM; and WHEREAS, the former RDA is now a dissolved community redevelopment agency and the Costa Mesa Housing Authority ("CMHA") acts as the "housing successor" all pursuant to Assembly Bill x1 26 enacted June 27, 2011, the California Supreme Court's decision in CRA v. Matosantos issued December 29, 2011, and Assembly Bill 1484 enacted June 27, 2012 (together, "Dissolution Laws"); and WHEREAS, the City and CMHA desire to modify the Guidelines of the City of Costa Mesa Single Family Rehabilitation Loan And Grant Program to increase the Grant amount to $14,000.00 for qualifying Participants/Single Family home owners and $10,000.00 for qualifying Participants/Mobile home owners; and WHEREAS, continuing to offer HOME rehabilitation grants is necessary in order for the City to continue receiving CDBG funds for Code Enforcement activities. HUD expects a community to have a reasonable housing rehabilitation program in place if it is uses CDBG funds to support code enforcement activities. (CDBG funds support two full-time Code Enforcement Officers and one full-time support clerical staff); and WHEREAS, City's CEO and the CMHA Executive Director is directed to modify the Guidelines relating to the criteria and requirements for City of Costa Mesa Single Family Rehabilitation Loan And Grant Program, which are to be reviewed on a case-by-case basis with review and input from the housing consultant, as set forth in and as recommended in the staff report presented with this agenda item; and Resolution No. 13-40 Page 1 of 3 WHEREAS, the City Council and CMHA have considered all public comments and testimony, both oral and written, that have been received about this agenda item. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA AND THE COSTA MESA HOUSING AUTHORITY AS FOLLOWS: Section 1. The foregoing Recitals are incorporated into this Resolution by this reference and constitute a material part of this Resolution. Section 2. The Guidelines for the CITY OF COSTA MESA SINGLE FAMILY REHABILITATION LOAN AND GRANT PROGRAM are directed to be modified by the CEO and Executive Director in consultation with legal counsel and the housing consultant to amend existing criterion to allow for, on a case-by-case basis and as determined reasonable based on HUD guidelines. In this regard, legal council shall update the policies and procedures, home owner and contractor agreements as needed. Section 3. The City Clerk and CMHA Secretary shall certify to the adoption of this resolution. PASSED AND ADOPTED this 17th day of September, 2013.
