REPEALING ORDINANCES NUMBERED 7.4-621 74-6301- 74-64, AND 74-65 CONCERNING FUNCTIONAL CONSOLIDATION AND REORGANIZATION BETWEEN THE CITY OF COSTA MESA -AND THE COSTA MESA PARK AND RECREATION DISTRICT.:AND THE COSTA MESA STREET LIGHTING ENERGY AND MAINTENANCE DISTRICT. THE CITY COUNCIL_OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS.FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa has heretofore passed_Ordinance 74-62.,.concerning functional consolidation of the City with the Costa Mesa Park and Recreation District; Ordinance 74-63, concerning functional consolidation of the City with the Costa Mesa Street Light- ing Energy and Maintenance District; Ordinance_74=64, concerning the governmental- reorganization of the City and the Costa Mesa Park and Recreation District; and Ordinance 74 -65, -concerning the.governmental reorganization of the City and -the Costa Mesa Street Lighting Energy and Mainte- nance District. -The City Council -further finds and declares that said Ordinances and each of them were passed in an effort to accomplish, by either means, the functional consolidation or governmental reorganization, respectively, of the City of Costa Mesa, a public agency, and both of said Districts, each of which is also a public agency, pursuant to alterna- tive'provisions available under -Part 4'of the California Revenue and Taxation -Code in order to better administer, finance, and operate the functions and obligations of said public agencies. The City Council further finds and declares that said efforts have been frustrated, due in.part to the noncon- forming boundaries of the City and said Districts which necessitate.the creation of complex taxing districts; due in part .to the time limitations imposed by law upon the City of Costa Mesa.and said Districts in performing -annexations required to -conform their boundaries in time to be effective for the 1975-76 tax year; and -due -in part to the difficulty in determining the -precise meaning of the above cited -Part 4 .of the California Revenue and Taxation Code, and their coordination with relevant parts of the California Government Code within the time limitations -imposed by law. Thus, compelling said public agencies to rescind and revoke their prior efforts -immediately in -order that there be no loss of tax revenue or inadvertent reduction of maximum property tax rate limits as imposed by Part 4 of the California Revenue and Taxation Code.. SECTION. 2. The City Council of the City of Costa Mesa. adopts this.Ordinance as an.urgency ordinance pursuant to Section: 36934, -California Government Code, the reason in support of the urgency beingthat the aforementioned Ordi- nances 74-62, 74-63, 74-64, and 74-65 must be repealed in order not_to conflict with the resolution setting the annual tax rate. . SECTION. 3. A. Ordinances 74-62 and 74-63 concerning the func- tional consolidation between the City of Costa Mesa and the Costa Mesa Park and Recreation District and the Costa Mesa Street Lighting Energy.and Maintenance District, respectively, pursuant to applicable provi- sions of Part 4 of the California Revenue and Taxation Code are hereby repealed. B.- Ordinances 74-64 and 74-65 concerning the govern- mental reorganization of .the City of -Costa Mesa with the Costa Mesa Park and Recreation District and the Costa Mesa Street Lighting Energy and Maintenance District, respectively, pursuant to applicable provi- sions of -Part 4 of the California Revenue and Taxation Code are hereby repealed. - 2 - C. The repeal of the aforesaid Ordinances, affecting said public agencies, is intended to reinstate the identical legal relationships, jurisdiction, obliga- tions, power, and authority of the respective public agencies as they existed at the time immediately prior to the enactment of said Ordinances 74-62, 74-63, 74 - and 74-65 as if said Ordinances had never been enacted. SECTION 4.. This Ordinance shall take effect immedi- ately from and after its passage, and prior to the expiration of fifteen ('15) days from the passage thereof, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
