AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA PROHIBITING SMOKING IN THE COUNCIL CHAMBERS DURING ALL PUBLIC MEETINGS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares that the orderly conduct of business of the City Council of the.City of Costa Mesa, the comfort and health of those persons of the community attending Council meet- ings, the efficiency of the staff and of the Council require that smoking be prohibited in the City Council Chambers during any public meetings. The City Council further finds and declares that the health, safety and welfare of the community require regulation of smoking in .the City Council Chambers during any and all public meetings. Accordingly, there is herewith added to Title 2, Chapter III, §2-86 and §2-87 which are as follows: SECTION 2: DEFINITIONS A. As used in this ordinance the term "smoking" shall mean the use of tobacco in the form of cigarettes, cigars, pipes or in any form which includes the process of combustion or burning leaving a smoke residue in the air. B. As used in this ordinance the term "Council Chambers" shall mean that portion of the City Hall designated as the Council Chambers generally usually occupied by the City Council. Council Chambers shall not include the conference room immediately adjoining the City Council Chambers or the hallway giving access to the Coucnil Chambers on the south and to the conference room. 52-86 SMOKING PROHIBITED -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Smoking as defined in this Ordinance shall be prohibited in the City Council Chambers as the same is defined :herein: during any meeting open to the public, whether or not the public is in attendance. §2-87 PENALTY Violation of this Ordinance shall be deemed a misdemeanor and shall.be punished in accordance with the provisions set out in §1-33 of the Costa Mesa Municipal Code. SECTION 3: This ordinance shall take effect and be in full force and effecty thirty (30) days from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
