HomeMy WebLinkAbout75-51 Vehicle Load Limits1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE N0. $$.S/ AN URGENCY ORDINANCE OF THE CITY.COUNCIL OF THE CITY OF COSTA MESA ESTABLISHING A VEHICLE LOAD LIMIT OF 6,000 POUNDS PER VEHICLE AS AUTHORIZED BY §35701 CALIFORNIA VEHICLE CODE ON PAULARINO AVENUE BETWEEN THE NEWPORT FREEWAY AND BEAR STREET, AND SETTING FORTH REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa finds and declares that the surface,subsurface and construction of Paularino Avenue between Newport Freeway and Bear Street will not withstand the continuous pressure of motor vehicle use, where said vehicles exceed a load limit of 6,000 pounds per vehicle. The City Council of the City of Costa Mesa further finds and declares that §35701 California Vehicle Code authorizes the establishment of maximum load limits on public streets. The City Council of the City of Costa Mesa further finds and declares that because of freeway construction in the immediate vicinity earth moving vehicles are using the aforesaid route to the extent that serious damage to the surface, subsurface and underground utilities is imminent. Accordingly, there is herewith added to Title 10, Chapter XIII the following section: SECTION 2:. There is hereby added to Title 10, Chapter XIII the following section: "S10-249 Load Limit - Paularino Avenue A maximum load limit of 6,000 pounds per vehicle is hereby established on Paularino Avenue between the Newport Freeway and Bear Street and it shall be unlawful for any motor vehicle or other use of said street in excess, of the herein set forth limits. X10-250 Penalty -1- I 1 2 3 4 5 6 r 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Exceeding the load limit as set forth in §10-249 shall be deemed a misdemeanor and -shall be publishable as set forth in 51-33 of the Costa Mesa Municipal Code." SECTION 3: This ordinance is adopted as an urgency ordinance as authorized by §36934 California.Government Code and the reasons for -said urgency are that the street governed by this ordinance is currently being used by earth hauling vehicles in connection with the construction of the Newport Freeway to the extent that irreparable damage is imminent. The passage of this ordinance in due course will result,in its effective date being after irreparable damage has been done. SECTION 4: This ordinance shall take effect and be in .full force and effect immediately from and after its passage and before the expiration of fifteen (15) days after its passage shall be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed and published in the City of .Costa Mesa, together with the names of the members of the City Council voting for and against the same.
