HomeMy WebLinkAbout74-07 Adding Use to Recreation District9 10 11 12 13 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 711-/ AN URGENCY ORDINANCE OF THE CITY OF COSTA MESA ADDING AND CREATING AN ADDITIONAL USE TO THE INSTITUTIONAL AND RECREATIONAL DISTRICT, AS ESTABLISHED BY THE ORDINANCES OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City of Costa Mesa hereby finds and declares that Division XVI, Sections 9297.1 through and including 9297.5 relate the certain institutional and recreational uses. The City Council further finds and declares that uses set forth therein are general in nature, and should be further refined for their practical application, both to existing and proposed uses within the City of Costa Mesa. Accordingly, there is herewith adopted Division XVIII, which shall read as follows: SECTION 2: DIVISION XVIII I and R -S. - INSTITUTIONAL AND RECREATIONAL - SCHOOLS Section 1. Uses Permitted. Educational Institutions either public or private. primary, secondary and collegiate. Section 2. Property Development Standards. a. Minimum lot area, 6,000 square feet. b. Minimum lot width, 60 feet. C. Maximum building height, none Section 3. Yards Required. In all cases yards shall be as determined by building setback lines shown on the offical district map for the City of Costa Mesa. Section 4. Special District Requirements. a. In all cases a master plan of site development shall be filed with the Planning Commission of the City of Costa Mesa. - 1 - I b. Uses incidential to the main function 2 of the development shall be permitted upon approval by the City 3 Council after recommendation by the Planning Commission, a 4 request for accessory uses shall be filed not less than ten (10) 5 days prior to the next regular Planning Commission. 6 C. Site plans shall meet the requirements 7 of all state agencies having jurisdiction over the design con - 8 struction and operation of public and private school facilities. 9 Section 5. All uses permitted shall be conducted 10 under roof, except uses incidental and appurtenant to the use 11 or uses conducted under roof. 12 SECTION 4: This Ordinance is adopted as an urgency 13 Ordinance as provided for in Section 36934 California Government 14 Code, and the reason for the urgency are as hereinafter set out. 15 The Legislature for the State of California mandated 16 that all zones must conform with the General Plan as of January 17 1, 1974. In the interests of expediency in designing zones to 18 conform with the General Plan, and in the interest of reducing 19 the gap between the mandated date of conformity and actual 20 conformity, it is necessary that this Ordinance be adopted as 21 an urgency ordinance. 22 SECTION 5: This Ordinance shall take effect and be 23 in full force and effect immediately from and after its passage, 24 and before the expiration of fifteen (15) dags after its passage, 25 shall be published once in the Orange Coast Daily Pilot, a news - 26 paper of general circulation printed and published in the City of 27 Costa Mesa, together with the names of the members of the City 28 Council voting for and against the same. 29 PASSED AND ADOPTED this—.741t day of 1974. 30 ATTEST: 31 32 City Clerk of the City o Costa Mesa 01 - 2 - STATE OF CALIFORNIA ) COUNTY OF ORANGE ) Ss CITY OF COSTA MESA ) I, EILEEN P.
