2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA AMENDING CERTAIN SECTIONS OF
3 THE COSTA MESA MUNICIPAL CODE, TO PROVIDE
FOR THE TERMS OF OFFICE OF PLANNING COMMISSION,
4 CITY CLERK, CITY TREASURER AND CITY ATTORNEY
AND SETTING FORTH REASONS THEREFOR.

6 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
7 ORDAIN AS FOLLOWS:
8 SECTION l: City Council of the City of Costa Mesa finds
9 and declares that the best interests of the persons to be
10 governed by the City Council of the City of Costa Mesa requires
11 that certain officers of the City serve only at the pleasure
12 of the City Council. The City Council further finds and declares
13 that the general law of the State of California authorizes the
14 enactment of ordinances governing the appointment and removal
15 of Planning Commissioners and other appointive officers for the
16 City. The City Council further finds and declares that the
17 health, safety and welfare of the City of Costa Mesa can best
18 be served by an unrestricted right of appointment of Planning
19 Commissioners and certain officers of the City of Costa Mesa.
20 Accordingly, the following amendments are adopted
21 to the Costa Mesa Municipal Code in furtherance of the findings
22 heretofore set forth.
23 SECTION 2: Section 2-3 of the Costa Mesa Municipal
24 Code is hereby amended to read as follows:
25 "Section 2-3 Appointments, City Clerk, City Treasurer
and City Attorney

27 The City Council shall appoint a City Clerk, a City
28 Treasurer and a City Attorney to serve and hold office at and
29 during the pleasure of the City Council. Removal of these
30 city officers from their respective posts shall be done in the
31 same manner as provided for in Section 2-135 through and including
32 Section 2-139 of this Code."

SECTION 3: Section 13-2 of the Costa Mesa Municipal
Code is hereby amended to read as follows:
"Section 13-2 Appointment of Commission.
The members of the Planning Commission shall be appointed
by the Mayor with the approval of the City Council and not-
withstanding the provisions of Section 13-3 of this Code shall
hold office at and during the pleasure of the City Council."
SECTION 4: This ordinance shall take effect and be in
full force and effect thirty (30) days from and after its passage,
and before the expiration of fifteen (15) days after its passage,
shall be published once in the Orange Coast Daily Pilot, a news-
paper of general circulation printed and published in the City of
Costa Mesa, together with the names of the members of the City
Council voting for and against the same.

considered section by section at a regular meeting of said City
Council held on the 6th day of May , 1974 and thereafter
passed and adopted as a whole at a regular meeting of said City
Council held on the 20th day of May 1974 by the following
roll call vote:
AYES: COUNCILMEN: Wilson, Hammett, Pinkley, Raciti,
Hertzog
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
