HomeMy WebLinkAbout74-35 Reducing Penalty Clause $6 to $31' 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 74-35 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA AMENDING SECTION 3-105 OF THE COSTA MESA MUNICIPAL CODE REDUCING THE PENALTY CLAUSE FROM $6.00 to $3.00 AND STATING REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa finds and declares that a penalty of $6.00 in addition to the License fee for dogs is self defeating. The City Council further finds and declares that said penalty tends to encourage owners of unlicensed dogs to avoid licensing altogether rather than appearing for a late license and paying late fees. The City Council further finds and declares that a fee equal to the license for late application is unreasonable. Accordingly, Section 3-105 of the Costa Mesa Municipal Code is amended to read as follows: SECTION 2: "Section 3-105 License Delinquency Date; Additional Fee. Licenses shall become delinquent thirty (30) days following the date on which they are due, and all delinquent licenses shall be subject to a payment of penalty of $3.00 in addition to the license fee." SECTION 3: Section 3-7 is hereby amended to read as follows: "Section 3-7 License Year Established. The license year under this title shall commence on July first of each year and shall end on June thirtieth of the following year."I SECTION 4: This ordinance is adopted as an urgency ordinance pursuant to Section 36934 California Government Code. The reasons in support of the urgency actions of the City Council of the City of Costa Mesa are as follows: Licenses are due on July 1 of any calendar year and are - 1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 delinquent thirty (30) days thereafter. It is necessary that this ordinance be adopted as a urgency ordinance to provide ample time for the preparation and printing of the necessary forms and the development of procedures and training of personnel in the license bureau for the adjustment provided for in this ordinance. SECTION 5: This ordinance shall take effect and be in full force and effect immediately from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
