AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ENACTED TO PRESERVE THE STATUS
QUO OF LAND USE IN THE CIVIC CENTER AREA; ADOPTING THE
SAME AS AN URGENCY ORDINANCE AND STATING REASONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa finds and declares
that it is necessary to adopt as an urgency measure this Interim Ordinance
prohibiting any use in the Civic Center area which may be in conflict with a
contemplated zoning proposal under consideration by the City Council.
Accordingly, the City Council of the City of Costa Mesa enacts the
following sections:
SECTION 2. (A) All uses are prohibited in an area described in a plot
plan attached to this ordinance marked Exhibit "A" and by this specific refer-
ence made a part hereof, and no building permit shall be issued for construction
within said area for the duration of this Ordinance.
SECTION 3. The City Council finds and declares that to protect the
public's safety, health, and welfare, this Ordinance is adopted as an urgency
measure.
SECTION 4. The reasons in support of the urgency actions of the City
Council are as follows:
(A) It is the intention of the City Council to encourage
development in the Civic Center area that would preserve and enhance
environmental quality and promote the attainment of the economic and
social objectives of the General Plan.
(B) A pending sale of a portion of the vacant land included
in the Civic Center area has caused to occur considerable speculation
as to how the entire area will be developed.
Because no comprehensive, long term plan exists for the Civic
Center area, development.decisions must be made on a piecemeal basis.
As,a result, the opportunity to develop a strong community focal point
will be lost. Additionally, the lack of a comprehensive plan increases
the likelihood of land use conflicts between existing and incre-
mental developments. Finally, the Civic Center complex constitutes
a substantial public investment which should be protected from the
encroachment of incompatible land uses.
(C) The City Council of the City of Costa Mesa does hereby
direct the staff to study the subject area and identify for public
discussion, development options.
(D) In order to protect the public safety, health, and welfare,
changes in land use and intensity of use are prohibited for the dura-
tion of this Ordinance.
SECTION 5. This Interim Ordinance shall take effect and be in full force
and effect immediately after its passage, and before the expiration of fifteen
(15) days after its passage, shall be published once in the Orange Coast Daily
Pilot, a newspaper of general circulation printed and published in the City
of Costa Mesa, together with the names of the members of the City Council
voting for and against the same.
