AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, PROHIBITING USES WHICH MAY BE IN
CONFLICT WITH A COMTEMPLATED ZONING PROPOSAL, DECLARING
SAID ORDINANCE TO BE AN URGENCY ORDINANCE, SETTING FORTH
THE REASONS THEREFOR, AND STATING THE AUTHORITY THEREFOR
TO BE SECTION 65858, CALIFORNIA GOVERNMENT CODE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa finds and declares
that the health, safety, and general welfare of the community requires the
prohibition of uses in certain areas which may be in conflict with the General
Plan. The City Council further finds and declares that certain areas having
already been committed to uses consistent with existing zoning, either through
plans for construction, expenditure of funds, or the creation of legal obliga-
tions should be exempt from said prohibition of use.
Accordingly, the following urgency measure is adopted.
SECTION 2. Interim Ordinance No. 73-41 is hereby amended to add to the
excluded area from the provisions thereof, all of that certain territory as
appears on a map attached to this Ordinance marked Exhibit "A" and by this
specific reference made a part hereof.
Ordinance No. 73-36, enacted by the City Council of the City of Costa Mesa
on the 4th day of October, 1973, other than amended herein, and in all other
particulars, is in full force and effect and continues to be ordinance law of
the City of Costa Mesa.
SECTION 3. The City Council finds and declares that the protection of
the health, safety, and general welfare of the community requires that this
Ordinance be adopted as an urgency measure, pursuant to Section 65858,
California Government Code.
The reasons in support of the necessity of an urgency measure are as
follows: Owner of the property has committed himself irreversibly to its
development by the expenditure of large sums of money, preparation of plans, and
other legal commitments, and will suffer irreparable damage if his property is
not excluded from the prohibitions set forth in Ordinance No. 73-36.
SECTION 4. This Ordinance shall take effect and be in full force and
effect immediately from and after its passage, and before the expiration of
fifteen (15) days after its passage, shall be published once in the Orange
Coast Daily Pilot, a newspaper of general circulation, printed and published
in the City of Costa Mesa, together with the names of the members of the City
Council voting for and against same.
