AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, AMENDING ORDINANCE
NO. 75-27 CONCERNING THE ADOPTION OF HEALTH
PROVISIONS UNDER STATE EMPLOYEE HOUSING ACT,
ESTABLISHING PERMITS, FEES AND ENFORCEMENT
THEREOF IN LABOR CAMPS
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
THAT. WHEREAS, the City of Costa Mesa has.heretofore
assumed responsibility for the enforcement of the State of
California's Employee Housing Act [Labor Code §2610 - §2646] and
related regulations of the California Administrative Code, Title
25, by adoption of Ordinance No. 75-27 [codified as CMMC 59-90.1]
and Resolution Nos. 74-43, 74-43A and 74-43B implementing same;
and
WHEREAS, subsequent amendments to the California
Administrative Code, Title 25, §2616 changed and redefined the
term "labor camp" to include employee housing in areas other
than'"farm".labor- camps; and
WHEREAS, said previously adopted Ordinance and
Resolutions limited the definition and application to "farm labor
camps" and this. amendment and addition is intended to expand same
and incorporate the existing state law and designate the Orange
County Health Department as the enforcement agency for the City
of Costa Mesa.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
SECTION 1: COSTA MESA MUNICIPAL CODE, TITLE 8,
CHAPTER I is hereby amended by adding the following:
"§8-2 EMPLOYEE HOUSING ACT ADOPTED
(1) The provisions of California Employee Housing
Act, Division 2, Part 9 (Health), Chapter 4, §2610 to §2646
inclusive, of the California Labor Code as amended, are hereby
adopted as set forth hereinafter and in Costa Mesa Municipal Code

(2) The City Council.designates the Orange County
Health Department as the enforcement agency of the.provisions of
said Act and all rules and regulations enacted pursuant thereto.
SECTION 2: COSTA MESA MUNICIPAL CODE §9-90.1 is
hereby amended to read as follows:
§9-90.1 LABOR CAMP PERMITS
(1)_ Pursuant to the provisions of §2640 of the
Labor Code, every person applying for an annual permit to operate
a labor camp shall pay the following fees to the Health Officer:
(a) A permit issuance fee of $25.00;
(b) A permit to operate fee of $6.00 for each
employee which the labor camp has the capacity to house, where
such housing is supplied by the operator, and a fee of $6.00 for
each lot or site provided for parking of mobilehomes or recreation-
al vehicles by employees;
(c) An amended permit fee of $25.00 for any
transfer of ownership or possession of the labor camp;
(d) An amended permit fee of $25.00, and
other fees specified in this section, for any increase in the
number of employees to be housed or an increase in the number
of lots or sites provided for parking of mobilehomes or recreation-
al vehicles by employees.
(2) Reinspection Fees
The fees for a permit to operate shall be considered
as inspection fees for the initial annual inspection of a labor
camp. When any reinspection is required pursuant to Title 25,
California Administrative Code, §2016.4 the operator shall pay a
fee for such reinspection as follows:
(a) $25:00 provided that such inspection is
not in excess of one hour in duration;
(b) If such inspection is in excess of one

hour in duration, $25.00 plus $12.50 for each thirty minutes
or fractional part thereof in excess of one hour.
SECTION 3: City Council Resolutions numbered 74-43,
74-43A and 74-43B concerning the City of Costa Mesa's assuming
responsibility for enforcement of the said Employee Housing Act,
designating the Orange County Health Department as enforcement
agency for the City and setting forth the effective date and
distribution of certified copies thereof shall remain in full
force and effect as to enforcing said'Act as amended herein."
SECTION 4: This ordinance shall take effect and be
in full force and effect thirty (30) days from and after its
passage, and before the expiration of fifteen (15) days after
the passage thereof shall be published once in the Orange Coast
Daily Pilot, a newspaper published in the City of Costa Mesa,
County of Orange, State of California, together with the names
of the members of the. City Council voting for and against the
same.
