HomeMy WebLinkAbout76-20 Amend AppointingTraffic Commissioni I ORDINANCE NO. 74--7,0 2 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA AMENDING SECTION 10-44 OF THE 31 COSTA MESA MUNICIPAL CODE RELATING TO THE APPOINT- MENT OF TRAFFIC COMMISSIONERS; ESTABLISHING TERMS 4 AND SETTING FORTH REASONS FOR THE URGENCY. 5 6 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY 7 ORDAIN AS FOLLOWS: 8 SECTION 1: The City Council of the City of Costa Mesa 9 finds and declares that X10-44 of the Costa Mesa Municipal Code 10 is in a form adopted for the previous Traffic Commission and 11 does not accurately reflect the terms of appointments designated 12 by the City Council to fill vacancies of the existing Traffic 13 Commission. The City Council further finds and declares that 14 in order to meet the current requirements of the City Council 15 for appointments and for terms, it is necessary that §10-44 16 of the Costa Mesa Municipal Code be amended. The City Council 17 further finds and declares that said amendment also is necessary 18 to resolve any confusion which might exist with respect to the 19 authority of holdover Commissioners who may have continued to 20 Act after their appointments have expired and to resolve any 21 confusion which might have existed about vote actions taken by 22 any holdover Commissioner. 23 SECTION 2: This Ordinance is adopted as an urgency 24 ordinance pursuant to §36934 Government Code. The reasons for 25 the urgency are as follows: 26 Because of resignations and the need to make new appoint - 27 ments a viable Traffic Commission does not now exist in the 28 City of Costa Mesa. 29 SECTION 3: Accordingly, X10-44 (b) of Chapter II, 30 Title 10 of the Costa Mesa Municipal Code is amended to read as 31 follows: 32 "(b) Beginning July 1, 1976 the member engaged -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in a commercial enterprise within the City of,Costa Mesa and the representative from the school community within the City of Costa Mesa shall be appointed for a period of four (4) years. The three (3) members from the community at large shall be shall be appointed for a two (2) year term with the provision that thereafter all terms of all members of the Traffic Commission shall be for a period of four (4) years from and after the date of appointment." At the end of said terms said appointments shall terminate and said positions shall be deemed vacant without further action of the Council. Nothing herein shall prohibit the Council, by appro- priate action, from appointing -any of said Commissioners for subsequent terms. Notwithstanding the terms of office established herein said Commissioners shall nevertheless serve at the will and pleasure of the City Council." SECTION 4: Section 10-44 (c) of Chapter II of Title 10 of the Costa Mesa Municipal Code is amended to read as follows: "(c) The Traffic Commission shall have as its staff the staff of the City of Costa Mesa who will prepare and make reports, recommendations, give technical advice and prepare Commission findings for consideration by the City Council." SECTION 5: This urgency ordinance shall take effect and be in full force and effect immediately from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. -2- y< -
