AN URGENCY ORDINANCE OF THE CITY -COUNCIL OF THE
CITY -OF COSTA MESA, CALIFORNIA, PROHIBITING .
PRIVATE VEHICLE PARKING ON MUNICIPAL LOTS DURING
CERTAIN TIMES.
THE CITY COUNCIL -OF THE CITY OF COSTA MESA, -CALIFORNIA,
DOES .HEREBT ORDAIN AS.FOLLOWSr
SECTION is The City Council of the City, of Costa Mesa,
..California,..does hereby find and'declare that this ordinance is,..
adopted,'as an -urgency ordinance pursuant'to.Government-Code §3.6934
and 369.37 for the following reasons:
;WHEREAS",'parking facilities adjacent to municipal buildings,
exist for the convenience of members of the public having legitimate
business with ,city officials or.employees,. and for,the convenience
of city employees during their working hours; and
WHEREAS, certain.private activities being conducted adjacent
to said municipal parking facilities have caused public use of said,
facilities inconsistent with the purposes.for which said facilities
-were provided;_and
WHEREAS,'the presence -of -private vehicles parked upon,. and
moving within, municipal' -parking facilities creates -problems of
traffic law enforcement;_ -additional clean-up of said facilities,
and potential legal -liability which is greater than if the-facil-
ities
he facil-ities were.used only for the purposes for which they were provided;
and
WHEREAS, the presence of 'large and unusually wide vehicles
parked in municipal parking facilities is aesthetically not in
keeping with the character and appearance of civic buildings being
maintained in this city; and
WHEREAS, on occasion the use by private persons of said
parking facilities has interfered with the ingress and egress of
emergency vehicl,es.which must use said facilities; and
WHEREAS, the California Vehicle Code (§22519 and.21113)
permitSa city to prohibit parking on municipally owned or controlled.
parking facilities; and
WHEREAS, the public health, safety and welfare will be
best served by prohibiting the.parking of private vehicles on
municipal parking facilities during certain hours and for purposes
unrelated to city business; and
SECTION 2: There is hereby added to Chapter 10 of Title 10
of the Costa Mesa Municipal Code, the following article which shall
read as follows:
ARTICLE II Restricted parking on City owned property.
§10-214 Definition
For purposes of this article vehicle shall mean any
truck, trailer, camper, motor van, house car,.passenger automobile
or other vehicle licensed to be driven or.towed.upon a public street
or highway.
§10=215 Prohibited Parking
It shall be unlawful for -any person, -firm, corporation,
or other entity to.park other than city owned,,or operated, vehicles
on city owned property posted with signs as herein provided.
§10-216 Exceptions
510-215 shall not apply to persons having legitimate
city business to conduct at.said premises, vehicles belonging to
persons attending City Council, Planning or Traffic Commission
meetings, or departmental seminars, vehicles belonging to city
officers and employees, or to any vehicle actively engaged in loading
orunloading goods or merchandise, or any vehicle undergoing emergency
repairs, or to any wrecker or similar vehicle actively engaged in
the repair or construction of improvements on municipal parking
facilities.
§10-217 Presumption
Vehicles not falling within the previous section which
are parked upon city owned property on weekends, or during the hours
of 5:00 p.m. to 8:00 a.m. on weekdays when no evening meetings as
described in §10-216 above are being held shall be presumed to be.
illegally parked.
§10-218 Posting
Signs designating restricted parking and bearing the
legend "Parking for City Business Only" pursuant to this article
shall be posted on such municipal property as otherwise provided
by law.

X10-219 Penalty
Violations herein shall be punishable under §1-33 of
the Costa Mesa Municipal Code.
X10-220 Enforcement
Reserve police officers and police 'cadets shall be
charged with the responsibility of enforcing the provisions of this
article. Vehicles found parked.in violation of this article may be
cited or.towed away and stored by the city. Any towing and storage
charged shall be due and payable by the owner or possessor of such
vehicles prior to its being released. If no owner or possessor
claims such vehicle within thirty (30) days, it may be sold for such
costs in the manner provided in California Vehicle Code 522705 or
§22850 et seq.
SECTION 3: This urgency ordinance shall take.effect and
be in full force and effect immediately from and after its passage,
and before the expiration of fifteen (15) days after its passage,
shall be published once in the Orange Coast Daily Pilot, a newspaper
of general circulation printed and published in the City of Costa Mesa,
together with"the names of the members of the City Council voting
for and against the same:
