HomeMy WebLinkAbout77-37 Urgency Ordinance77- 7 - 77 7-7-77 ORDINANCE NO. 77-3 7 r AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, EXTENDING THE EFFECT OF ORDINANCE NO. 77-14 CONCERNING A FREEZE ON BUILDING PERMITS OR REVISED USES IN THE GENERAL AREA BETWEEN PALACE AVENUE, NINETEENTH STREET, POMONA AVENUE AND HAMILTON STREET, AND, BETWEEN BERNARD STREET, CHARLE STREET, MAPLE AVENUE, AND HAMIL^1ON STREET, DECLARING SAID ORDINANCE TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa finds and declares that Ordinance No. 77-14 was adopted as an urgency interim ordinance to allow further studies of land uses within said area in contemplation of zoning legislation; that +0 said studies are not completed as yet dueAthe press of other land developments and staff time limitations and that additional time is needed to complete same and therefore adopts this ex- tension of said Ordinance No. 77-14 pursuant to California Govern- ment Code §65858 for the general health, safety and welfare of the public. Accordingly, the following urgency ordinance is adopted herewith: SECTION 2: All uses are prohibited in a general area bounded by Hamilton Street on the north, 19th Street on the south, Pomona Avenue on the east and Palace Avenue on'the west, and bounded by Hamilton Street on the north, Bernard Street on the south, Maple Avenue on the west, and Charle Street on the east, excluding therefrom certain territory, all as appears on maps attached to this Ordinance marked Exhibit "A" and Exhibit "B" and by this specific reference made a part hereof. The City staff is hereby directed not to issue any permits of any kind for construction or use within the aforementioned area for the duration of this Ordinance, provided that any application for City action that has been filed with the City, or permit issued by the City within the said area before the effective -1- date of Ordinance No. 77-14, shall not be denied, enjoined or other- wise prevented from being pursued or completed solely by reason of these Ordinances having been adopted. Such projects may be processed or completed if otherwise approved by the City. SECTION 3: The reasons in support of the necessity of this urgency interim ordinance are as follows: Existing zoning in the Study Area allows construction of multiple units at R-3 and R-4 densities on narrow, deep lots. Such development is creating unsafe fire protection conditions due to inadequate water mains and inadequate and obsolete hydrants. Traffic circulation efficiency is also reduced due to the nec- essity for access to each narrow lot and the unimproved status of Palace and Sterling Avenues. The continuation of R-3 and R-4 densities on these narrow, deep lots in contributing to the blight of this section of the City. The prevention of neighbor- hood blight requires that existing public policy conflicts be resolved prior to allowing further development. That additional time is required to complete the in-depth studies necessary to evaluate and adopt land use regulations that benefit said Study Area and the general health, safety and wel- fare of the public. SECTION 4: This ordinance shall take effect and be in full force and effect immediately from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. The -City Clerk is directed to file this as a Miscellaneous Ordinance and not file it in the Costa Mesa Municipal Code. PASSED AND ADOPTED this �b day of , 1977.
