HomeMy WebLinkAbout77-38 Arnel Development CompanyORDINANCE NO. 77-38 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONCERNING THE ADOPTION OF THE FINAL DEVELOPMENT PLAN OF ARNEL DEVELOPMENT COMPANY FOR THE PLANNED DEVELOPMENT. LOCATED ON SOUTH COAST DRIVE BETWEEN BEAR STREET AND SAN LEANDRO LANE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares that the developer, Arnel Develop- ment Company, has heretofore processed a Preliminary Develop ment Plan, being ZE-76-208A, for the planned development located in the PDR -LD and the PDR -MD zones at the southwest corner of Bear Street and South Coast Drive; that said Preliminary Development Plan has heretofore been processed and approved pursuant to Section 13-247, et seq., Costa Mesa Municipal Code. The City Council of the City of Costa Mesa further finds that said developer has.now submitted a Final Develop- ment Plan for said development which has been found by the Costa Mesa Planning Commission, by Resolution No. PC -77-13, to substantially comply with the intent, standards, and procedures of said ordinance; the California Environmental Quality Act; Chapters 3 and 4 of Title 7 of the California Government Code relating to Local Planning; and Articles 2, 3, and 4, Chapter III-, Title.13 of the Costa Mesa Municipal Code to the extent applicable,. which findings are approved and adopted herein; that no major change to said Final Development Plan has occurred subsequent to its approval by said Resolution; finally, the City Council of the City of Costa Mesa finds that this matter is being adopted by ordinance, rather than resolution, to comply with applicable laws and shall not require inclusion in the Costa Mesa Municipal Code since it concerns one parcel of land only and may be indexed on the City Clerk's Miscellaneous Uncodified Ordinance list. SECTION 2. The Final Development Plan of Arnel Development Company for the planned development, being ZE- 76-208A; located in the PDR -LD and PDR -MD zones on South Coast Drive between Bear Street and San Leandro Lane, is hereby approved as amended: as shown in Exhibit "A" at- tached hereto and made a part hereof. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof, shall be published. -once in the Orange Coast Daily Pilot,. a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. "Design and install under the dir,.ection of the City Engi- neer, one traffic signal on.South Coast Drive at the apartment entrance, complete with interconnect conduit to Bear Street. The City will enter into.an agreement with the Arne1 Development Company to require.the developer of the parcel to the north to reimburse the Arnel Development for one-half the cost of the traffic signal, if the developer of the-property.to the north desires access -to South Coast Drive at the signal." Condition No. 18 amended to read as follows: "Deposit 25 percent of cost of the traffic signal on South Coast Drive at San Leandro. Lane (estimated..$50,000.00; 25 percent equals $12,500.00) including design, inspection, and construction." EXHIBIT "A" Ordinance No. 77-38 -
