HomeMy WebLinkAbout78-42 Changing notification requirements for zone exception permits/rezonest ORDINANCE NO. %,?- Z1j + AN ORDINANCE OF THE'CITY COUNCIL OF THE CITY OF COSTA MESA AMENDING TITLE 13 OF THE COSTA MESA MUNICIPAL CODE CHANGING NOTIFICATION REQUIREMENTS FOR ZONE EXCEPTION PERMITS AND REZONES. FOLLOWS: THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: 1. That the present City requirements for notification of property owners of Zone Exception and Rezone actions are duplicative, costly, and inefficient; and 2. That said City notification requirements go beyond mandatory State law require- ments; and 3. That the posting of notification cards on the City streets adds to clutter and a general reduction of the quality of the appearance of the City without providing an effective means of notifying affected parties. Accordingly, the City Council of the City of Costa Mesa herewith amends Title 13 of the Costa Mesa Municipal Code by amending and deleting Sections and Articles as hereinafter setforth: SECTION 2: ARTICLE 22 - GENERAL PROVISIONS AND EXCEPTIONS X13-321 Nonconforming Uses (8) A Zone Exception Permit may be approved by the Planning Commission for a nonconforming use if the Planning Commission finds that the circumstances outlined in Section 13-352 are applicable. ARTICLE 23 - ZONE EXCEPTION PERMITS S13-343 Procedures 3. Fee Schedule (2) The fee for the following minor Exceptions shall be $25 for the first Exception request and $5 for each additional request per application: • (a) Reduction in lot area requirements not to exceed 10% of the required lot sizes. (b) Reduction in all yard requirements which do not exceed a total of 50% of any single required yard area. (c) Additional height requirements which do not exceed one story or ten additional feet. (d) Home occupation as outlined in this Chapter. §13-346 Notices Notices of the hearing shall be mailed to all owners of property within a radius of 300 feet of the external boundaries of the property described in said petition not less than five (5) days nor more than ten (10) days prior to the hearing. The Planning Department shall use for this purpose the last known name and address of such owners as shown on the tax roll of the County of Orange. Said notices shall contain all pertinent data related to said request. §13-350 Notice of Decision Delete §13-351 Council Action Delete §13-352 Nonconforming Uses A Zone Exception Permit may be granted for the reconstruction or remodeling of con- forming or nonconforming buildings housing nonconforming uses if such permit will, in the Planning Commission's judgment, bring such building and subsequent use into greater conformity with the uses permitted in the Zoning District. ARTICLE 24 - AMENDMENT OR CHANGE OF DISTRICT BOUNDARIES §13-369 Publication and Mailing of Notices Notice shall be published once in a newspaper of general circulation, published in the City, not less than five (5) nor more than ten (10) days prior to the date set by the Commission for the hearing. Notices of the hearing shall be mailed to all owners of property within a radius of 300 feet of the external boundaries of the property described in said petition not less than five (5) days nor more than ten (10) days prior to the hearing. Said notices shall contain all pertinent data related to said request. -2- CHAPTER III - SUBDIVISIONS ARTICLE 2 X13-443 Action by Planning Commission (a) Deadline for considering: Within 50 days after a tentative map has been filed, the Planning Commission shall hold a public hearing -and shall either approve or disapprove said map. (b) Notification: Notice of said public hearing shall be published once in a news- paper of general circulation, published in the City, not less than five (5) nor more than ten (10) days prior to the date set by the Commission for the hearing, and a notice shall be mailed to all owners of property within a radius of 300 feet of the external boundaries of the property described in said map not less than five (5) nor more than ten (10) days prior to the hearing. The Planning Department shall use for this purpose the last known name and address of such owners as shown on the Tax Roll of the County of Orange. Said notices shall contain all pertinent data related to said request.. (c) Approval: In the event the Planning Commission shall approve said map,.their action shall be final, subject to review by the City Council as hereinafter provided. (d) Disapproval: In the event the map is disapproved, the reasons for such disapproval shall be given in a statement attached to the tentative map outlining the changes which will be required before such map will be acceptable, and the same shall be retained in the Planning Department records. Copies of said statement shall forth- with be forwarded directly to the subdivider or his agent. -3- - SECTION 3: This ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
