AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA LIMITING ACCESSORY STRUCTURES
IN RESIDENTIAL DISTRICTS TO ONE STORY, ES-
TABLISHING A SETBACK REQUIREMENT FOR FENCES
IN RESIDENTIAL DISTRICTS, AND PROHIBITING
PARKING IN REQUIRED SETBACKS ADJACENT TO
PUBLIC STREETS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: The City Council of the City of Costa Mesa
hereby finds and declares as follows:
1. That setback and height limitation requirements are
imposed in residential zones to provide adequate
light, air, and privacy; and
2. That two-story accessory structures impinge on the
light, air and privacy of adjacent residential
properties; and
3. That construction of walls and fences on the front
property line defeats the purpose of requiring a
setback; and
4. That provision of parking spaces in the required set-
back area defeats the purpose of requiring a setback;
and
5. That the enactment of these regulations is necessary
for the protection of the public health, safety, and
general welfare.
Accordingly, the City Council of the City of Costa Mesa
herewith amends Title 13 of the Costa Mesa Municipal Code by

amending and adding sections as hereinafter set forth:
SECTION 2: CHAPTER II
ARTICLE 7 - R1 SINGLE-FAMILY RESIDENTIAL
DISTRICT

5. Fences within ten (10) feet of the front property
line or the ultimate front property line shall not
exceed thirty (30) inches in height, and existing
structures or buildings not in compliance with
these provisions on the effective date hereof may
remain unless destroyed, damaged, or altered (by
any means or cause) to the extent of more than
fifty (50) percent of its value, then, the recon-
struction thereof shall conform to the provisions
herein.
§13-129 Accessory Buildings and Structures
6. The maximum building height shall be one story, not
to exceed fifteen (15) feet and existing structures
or buildings not in compliance with these provisions
on the effective date hereof may remain unless
destroyed, damaged, or altered (by any means or
cause) to the extent of more than fifty (50) per-
cent of its value, then, the reconstruction thereof
shall conform to the provisions herein.

S13-142 Site Improvement Requirements
1. All interior property lines shall have solid
opaque walls or fences constructed under the
direction of the Planning Department. If a
fence is constructed adjacent to a public street,
said fence shall be approved by the Planning De-
partment in terms of its compatibility and harmony
with the proposed building and site development,
and buildings and site developments existing or
approved for the general neighborhood. Fences
within ten (10) feet of the front property line
or the ultimate front property line shall not
exceed 30 inches in height, and existing structures
or buildings not in compliance with these provisions
on the effective date hereof may remain unless des-
troyed, damaged or altered (by any means or cause)
to the extent of more than fifty (50) percent of
its value, then, the reconstruction thereof shall
conform to the provisions herein.
CHAPTER V
ARTICLE 4 - RESIDENTIAL PARKING REQUIREMENTS

(5) Development Standards:
(c) No parking shall be permitted in any required
setback adjacent to a public street. Parking visi-
ble from a public street shall be screened in a
manner acceptable to the Planning Department.

SECTION 3: This ordinance shall take effect and be in
full force and effect thirty (30) days from and after its passage,
shall be published once inthe Orange Coast Daily Pilot, a news-
paper of general circulation printed and published in the City
of Costa Mesa, together with the names of the members of the City
Council voting for and against the same.
