HomeMy WebLinkAbout78-31 Final Development; 2915 Red HillORDINANCE NO. 78-31 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING THE ADOPTION OF THE FINAL DEVELOPMENT PLAN OF BYRON TARNUTZER BY ESTABLISHING PERMITTED COMMERCIAL USES FOR THE PLANNED DEVELOPMENT LOCATED AT 2915 RED HILL AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares that the developer, Byron Tarnutzer, has here- tofore processed a Preliminary Development Plan, being ZE-77-78, for the planned development located in an MP zone at 2915 Red Hill Avenue, Costa Mesa, California; that said Preliminary Development Plan has heretofore been processed and approved pursuant to Section 13-247 et seq., Costa Mesa Municipal Code. The City Council of the City of Costa Mesa further finds that the Final Development Plan of Byron Tarnutzer for the planned development, being No. ZE-77-78, located in an MP zone at 2915 Red Hill Avenue, Costa Mesa, was approved by Ordinance 77-32 adopted by the Costa Mesa City Council on July 18, 1977; finally, the City Council of the City of Costa Mesa finds that this matter is being amended by ordinance, rather than resolution, to comply with applicable laws and shall not require inclusion in the Costa Mesa Municipal Code since it concerns one parcel of land only and may be indexed on the City Clerk's 11iscellaneous Uncodified Ordinance list. SECTION 2. The amendment to Final Development Plan establish- ing permitted commercial uses for Byron Tarnutzer for the planned development, being No. ZE-77-78A, located in an MP zone at 2915 Red Hill Avenue, Costa Mesa, is hereby approved, said uses are shown on Exhibit A, attached hereto and made a part hereof. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
