HomeMy WebLinkAbout78-34 Permits Between Baker & PaularinoORDINANCE NO. 7g�34 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, EXTENDING THE EFFECT OF ORDINANCE NO. 78-24 CONCERNING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS OR REVISED USES IN THE GENERAL AREA BETWEEN BAKER STREET AND PAULARINO AVENUE, FROM 375 TO 1,433 FEET WEST OF THE CENTERLINE OF BRISTOL STREET, DECLARING SAID ORDINANCE TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THEREFORE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa finds and declares that Ordinance No. 78-24 was adopted as an urgency interim ordinance to allow for the completion and adoption of a Specific Plan for the general area between Baker Street and Paularino Avenue from 375 to 1,433 feet west of the centerline of Bristol Street; that the adoption of a Precise Plan of street alignment is necessary for the h-plemen- tation of said Specific Plan; and that additional time is required for the considera- tion and adoption of a Precise Plan of street alignment and, therefore, adopts this extension of Ordinance No. 78-24, with modification, pursuant to California Govern- ment Code §65858 for the general health, safety, and welfare of the public. Accordingly, the following Urgency Ordinance is adopted herewith: SECTION 2: All development is prohibited in the general area between Baker Street and Paularino Avenue from 375 to 1,433 feet west of the centerline of Bristol Street, excepting therefrom certain territory, all as appears on a map attached hereto marked Exhibit "A" and by this specific reference made a part hereof. The City Staff is hereby directed not to issue any permits of any kind for con- struction within the aforementioned area for the duration of this Ordinance, provided that any application for City action which has been filed with the City, or permit issued by the City within the said area before the effective date of Ordinance No. 78-24 shall not be denied, enjoined, or otherwise prevented from being pursued, or completed soley by reason of these Ordinances having been adopted. Such project may be processed or completed if otherwise approved by the City. SECTION 3: The reasons in support of the necessity of this Urgency Interim Ordinance are as follows: A Specific Plan (SP -78-02) has been adopted for this general area. The purpose of said Specific Plan is to resolve difficult, potentially hazardous traffic situa- tions which could result from the development of multiple -family units with the only access being directly from a heavily traveled Primary Highway. The adoption of a Precise Plan of street alignment is necessary for the implementation of said Specific Plan. Additional time is required for the consideration of alternative alignments and financing arrangements for the street prior to the adoption of a Precise Plan of alignment for the benefit of the area affected by this moratorium and the general health, safety, and welfare of the public. SECTION 4: This Ordinance shall take effect and be in full force and effect immediately from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. The provisions of this Ordinance shall be effective for a period of four (4) months after adoption. The City Clerk is directed to file this as a Miscellaneous Ordinance and not in in the Costa Mesa Municipal Code. PASSED AND ADOPTED this Za day of , 1978.
