AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA AMENDING SECTION 17-6 OF THE COSTA MESA MUNICIPAL CODE- CONCERNING THE STANDARDS AND PROCEDURES FOR SECURING PERMITS FOR TEMPORARY TRAILERS AND MODULAR STRUCTURES, EXCLUDING TRAILER PARKS (MOBILE HOME -PARKS). THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS SECTION 1: The City Council of the City of Costa Mesa hereby finds and.declares that the current procedure for regulating trailers and modular structures used for a temporary purpose during construction or remodeling of Permanent facilitites is cumbersome. This is not intended to apply to trailers or mobile homes placed in trailer parks or mobile home parks pursuant to Costa Mesa Municipal -Code §17-7 other than during construction of said trailer parks or mobile home parks. This ordinance is intended to simplify same by setting forth the standards and delegating the authority to issue permits in accordance therewith for the general health, safety and welfare of the public. SECTION 2: Accordingly, Title 17, Section 17-6 is hereby amended to read as follows: Section 17-6 Prohibited Use of Trailers A. "It is unlawful for any person or entity to place, use or occupy any trailer coach, mobile home or modular structure of a temporary nature for residential, commercial or industrial use upon any land, public or private, without a permit. This regulation does not apply to mere storage of same or to those used as residences within an authorized trailer park or mobile hone park. B. The Planning Director is authorized to approve the temporary use of trailers and/or modular structures while permanent facilities are being constructed or remodeled. Such temporary facilities may be approved for office and/or storage space in conmercial and industrial zones, or for churches and private schools regardless of applicable zoning. Approval shall be limited to a maximun-of one year. However, a upon request by the applicant, an extension may be granted by the Planning Director only if evidence is provided that extraordinary circumstances prevented the completion of the permanent facilities within the original one year time period, or if permanent facilities are near corrp letion.- C. Requests for such temporary facilities shall be submitted to the Planning Department. Said request shall be accompanied by a fully -dimensioned, scaled.plot plan of the entire property showing all existing structures and uses and the proposed location of the temporary facilities. Detail information to be shown on the plot plan shall include: property -line dimensions; setback dimensions; distances between buildings; location and design of parking facilities; and such other detail information as may -be required to properly evaluate the request. All plans submitted with the request shall be reviewed by the Building Department, Fire Department, and Planning Department, and conditions deemed appropriate by these departments may be imposed upon the approval of the temporary facilities. Proposed locations shall comply with all requirements of the Uniform Building Code, Uniform Fire Code, and all other codes, ordinances, and regulations adopted and administered by the City of Costa Mesa, as well as other conditions deemed necessary to guarantee the public health, safety, and general welfare. D. The placement of these temporary facilities for any use other than those listed above shall require approval by the Planning C mnission. E. Applications shall be made to the Planning Department acccmpanied by a filing fee for processing same of Ten ($10.00) Dollars or other fee as established by resolution of the City Council. SECTION 3: This ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa,.together with the names of the members of the City Council voting for and against the,same.
