AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, ESTABLISHING A MORATORIUM ON THE ISSUANCE OF
BUILDING PERMITS OR REVISED USES IN THE GENERAL AREA BETWEEN
BAKER STREET AND PAULARINO AVENUE, FROM 375 TO 1,433 FEET WEST
OF THE CENTERLINE OF BRISTOL STREET, DECLARING SAID ORDINANCE
TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THERE-
FOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa finds and declares
that the health, safety, and general welfare of the community requires the pro-
hibition of the development of properties in certain areas when such development
may be in conflict with a contemplated Specific Plan and zoning proposal.
Accordingly, the following urgency measure is adopted.
SECTION 2. All development is prohibited in the general area between
Baker Street and Paularino Avenue from 375 to 1,433 feet west of the centerline
of Bristol Street as appears on a map attached to this Ordinance marked Exhibit
"A".
The City Staff is hereby directed not to issue any permits of any kind for
construction within the aforementioned area for the duration of this Ordinance,
provided that any application for City action that has been filed with the City,
or permit issued by the City within the said area before the effective date of
this Ordinance, shall not be denied, enjoined, or otherwise prevented from being
pursued or completed solely by reason of this Ordinance having been adopted.
Such projects may be processed or completed if otherwise approved by the City.
SECTION 3. The City Council finds and declares that the protection of
the health, safety, and general welfare of the community requires that this
Ordinance be adopted as an urgency measure, pursuant to Section 65858, California
Government Code.
The reasons in support of the necessity of an urgency measure are as follows:
The existing zoning in the proposed Specific Plan areas allows the construc-
tion of multiple family units at an R2 density. Such development on the pro-
perties with frontage on Baker Street would create difficult, potentially
hazardous traffic situations inasmuch as Baker Street is a heavily used Primary
Highway and a raised median is planned which would restrict access. Traffic
circulation efficiency is further reduced by the relative narrowness of certain
parcels in the area which would require a large portion of the property to be
devoted to driveways.
That additional time is required to process a proposed specific plan designed
to guide the future development within said Study Area and to mitigate the anti-
cipated adverse consequences resulting from the development of the subject parcels
under the provisions of the existing land use and circulation policies for the
benefit of said Study Area and the general health, safety and welfare of the
public.
SECTION 4. This Ordinance shall take effect and be in full force mediately
frau and after its passage and prior to the expiration of fifteen (15) days
from the passage thereof, shall be published once in the Orange Coast Daily Pilot,
a newspaper of general circulation, printed and published in the City of Costa
Mesa, together with the names of the members of the City Council voting for and
against same. The provisions of this Ordinance shall be effective for a period
of four months after adoption.
