AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, AMENDING TITLE 13 OF THE COSTA MESA MUNICIPAL
CODE REGARDING SMALL CAR PARKING IN COMMERCIAL DEVELOPMENTS,
PARKING FOR RESTAURANTS IN THE INDUSTRIAL ZONES, AND RECODI-
FICATION OF AN EXISTING DEVELOPMENT STANDARD IN THE R3 ZONE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares
as follows:
1. That restaurants in industrial zones have parking needs similar to those of
restaurants in commercial zones.
2. That parking requirements adopted as part of Ordinance No. 80-16 regulating
off-street parking do not distinguish between restaurants in industrial zones and
other industrial uses.
3. That the City Council approved the concept of using small car parking spaces
in commercial, residential, and industrial developments when the Council adopted
Ordinance No. 80-16 regulating off-street parking.
4. That the City of Costa Mesa has adopted Standards and Policies for the utiliza-
tion of small car parking spaces within residential, ca miercial, and industrial zones;
5. That to require a Conditional Use Permit for all commercial developments uti-
lizing small car parking adds an undue processing burden that is not applied to indus-
trial or residential developments;
6. That permitting 25 percent of required parking in excess of 15 spaces in
commercial developments to be small car spaces is consistent with the Policies and
Standards of the City of Costa Mesa.
ACCORDINGLY, the City of Costa Mesa herewith amends Title 13 of the Costa Mesa
Municipal Code as hereafter set forth.

1. Repeal Section 13-162 subparagraph 5.
2. Add Section 13-149 subparagraph 6:
116. R3 developments shall be subject to the requirements set forth in
Article 8 1/2, contained within this title."
3. Amend Section 13-560: Small car parking
"Twenty-five percent (25%) of all parking spaces in excess of fifteen (15) may be
small car spaces. Said small car spaces shall ccmply with City of Costa Mesa Standards
for said spaces, and shall be clearly marked "SMALL CAR ONLY." The distribution, location,
and marking of small car spaces shall be subject to the approval of the Director of
Development Services.
Small car parking in excess of the above may be allowed by obtaining approval of a
Conditional Use Permit for the excess."
4. Add Section 13-564(d):
"Restaurants providing on-site seating for more than 12 persons shall
provide 10 spaces per 1,000 square feet of gross floor area for the first 3,000 square
feet and 20 spaces per 1,000 square feet for each additional 1,000 square feet above the
first 3,000 square feet."
SECTION 3: This Ordinance shall take effect and be in full force thirty (30) days
from and after the passage thereof, and prior to the expiration of fifteen (15) days
from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of
general circulation, printed and published in the City of Costa Mesa or, in the alterna-
tive, the City Clerk may cause to be published a summary of this Ordinance and a certi-
fied copy of the text of this Ordinance shall be posted in the office of the City Clerk
five (5) days prior to the date of adoption of this Ordinance and within fifteen (15)
days after adoption, the City Clerk shall cause to be published, the aforementioned

summary and shall post in the office of the City Clerk a certified copy of this Ordi-
nance together with the names of the members of the City Council voting for and against
the same.
