UD - oC Z AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COS'T'A MESA, CALIFORNIA, ADOPTING ADDITION NO. 3 TO THE EXISTING COSTA MESA REDEVELOPMENT PROJECT AREA NO. 1 (D9WNrlC7WN PROJECT AREA) . THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares that it has approved and adopted Ordinance No. 73-44 and Ordinance No. 77-27 (Addition Nos. 1 and 2) which were recommended to it by the Costa Mesa Redevelopment Agency; and The City Council further finds that the Redevelopment Agency now proposes Addition No. 3 to the existing Project Area No. 1; and The City Council further finds that pursuant to Section 33458 of the Health and Safety Code of the State of California, the Redevelopment Agency and City have jointly held a public hearing on November 3, 1980, to discuss Addition No. 3; and The City Council certifies that notification of the public hearing has been given pursuant to Section 33452 of the Health and Safety Code; and The City Council further finds that the proposed addition is not a substantial change in the adopted Redevelopment Plan; and The City Council further finds that pursuant to Section 33453, the Planning Commission has adopted a report on the proposed amendment and has adopted Resolution 80-25 finding consistency with the General Plan; and The City Council further finds that pursuant to Section 33455, it is required to adopt an Ordinance in order to amend the Project Area boundaries. Section 2: The City Council hereby declares its purpose and intent of including Addition No. 3 within the project area boundaries is to allow for uniform development of combined properties and to permit redevelopment in conformity with the interests of the public peace, health, safety, and welfare; and the carrying out of the Redevelopment Plan as amended will promote these interests. The City Council further finds that the area proposed for addition is a blighted area and redevelopment is necessary to effectuate public purposes stated in this part. Section 3: The original project area adopted in Ordinance 73-44 and Amend- ment 77-27, including Addition No. 3 as adopted herein, is designated as the official Redevelopment Project Area No. 1, and that Addition No. 3, as described in Exhibit A and shown in Exhibit B, is hereby incorporated and made a part hereof as fully set forth herein. Section 4: The City Council hereby declares that the inclusion of Addition No. 3 would be economically sound and feasible; and The City Council finds that the effect of tax increment financing for Addition No. 3 will not cause a severe financial burden or detriment on any taxing agency deriving revenues from a tax increment project area. Plan. Section 5: The Redevelopment Plan Amendment is in conformity with the General Section 6: The City Council hereby declares that condemnation of real property, as provided in the Redevelopment Plan, is necessary for the execution of the Rede- velopment Plan in that adequate provisions have been made for property to be acquired as provided by law; and The City Council hereby finds that the elimination of blight and redevelopment of the area added by this amendment may not be reasonably expected to be accomplished by private enterprise acting alone without agency assistance. -2 - Section 7: The Redevelopment Plan Amendment will not displace families in that none of the properties within Addition No. 3 are used residentially. Section 8: The Addition No. 3 consists of land, buildings, and improvements which are detrimental to the public health, safety, and welfare, an are necessary for the redevelopment of the area of which they are a part. Section 9: The City Clerk is hereby directed pursuant to Section 33457 to transmit a copy of this Ordinance, a description of the land within Project Area No. 1, and a map indicating the boundaries of Project Area No. 1 to the Auditor and Tax Assessor of Orange County, to the governing body of each taxing agency which levies taxes upon any property in Project Area No. 1, and to the State Board of Equalization. Such documents shall be transmitted as prcmptly as practicable following the adoption of this Ordinance; and The City Clerk is directed pursuant to Section 33456 to record with the County Recorder of Orange County a description of Addition No. 3 and a composite description of the Redevelopment Plan boundaries for Project Area No. 1 as amended. This Amendment shall be recorded pursuant to Government Code Section 27295. Section 10: Having considered all the evidence, verbal and written, the City Council hereby overrules all verbal and written objections to Addition No. 3. Section 11: This Ordinance shall take effect and be in force thirty (30) days from and after its passage, and before the expiration of fifteen (15) days after its passage shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council for and against the same.
