HomeMy WebLinkAbout80-25 Pertaining to Reserve Officers, Declaring said Ordinance to be an Urgency OrdinanceORDINANCE NO. 80-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, PERTAIN- ING TO RESERVE OFFICERS, DECLARING SAID ORDINANCE TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares the Reserves of the Costa Mesa Police Depart- ment comprise a skilled, experienced, well-trained group. The City Council further finds and declares that Section 832.6(b) of the California Penal Code provides for a procedure whereby a City Council may, prior to January 1, 1981, designate reserves as level I reserve officers, and that the Chief of Police may investigate the qualifications of candidates and the City Manager may determine that particular individuals are quali- fied to be level I reserve officers and perform general law enforcement duties by reason of training and experience. The City Council further finds and declares that the health, safety and general welfare of the community require such designation of level I reserve officers as described herein. The City Council finds and declares that the protection of the health, safety and general welfare of the community requires that this Ordinance be adopted as an urgency measure, pursuant to Section 36937(b) of the California Government Code. The reasons in support of the necessity of an urgency measure are as follows: The designation of such reserve officers as level I reserve officers is necessary to assure for the City the con- tinued availability of a reliable source of manpower for normal or emergency situations and designation is thus necessary for the immediate preservation of public peace, health or safety. SECTION 2. An urgency measure is adopted as hereinafter set forth, to be designated as Title 14, Chapter 3, Section 14-50.1; the City Council of the City of Costa Mesa does ordain as follows: Section 14-50.1 (a) All reserve police officers who are issued a Peace Officers Standards and TrainingLevel I Reserve Officer Certificate before January 1, 1981, shall have the full powers of a peace officer, where the City Manager, on the recom- mendation of the Chief of Police, has determined such reserve officer qualified to perform general law enforcement duties by reason of the reserve officer's training and experience. (b) This Ordinance retains in the Chief of Police the authority, control and command over the reserve police force and permits the adoption of rules and regulations limiting or designating the extent of authority of the various activities of the reserve officers. SECTION I. This Ordinance shall take effect and be in full force immediately after its passage, and before the ex- piration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. -2- PASSED AND ADOPTED this 15th day of December, 1980.
