HomeMy WebLinkAbout80-18 Amending Permitted Uses for the Planned Development Commercial, CL, C1, and C2 Commercial ZonesORDINANCE NO. 80-18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING TITLE 13 OF THE COSTA MESA MUNICIPAL CODE AMENDING THE PERMITTED USES FOR THE PLANNED DEVELOPMENT COMMERCIAL, CL, Cl, AND C2 COMMERCIAL ZONES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: 1. That increasing pressures and demands are being made on the use of land throughout the community; 2. That automotive repair is not always compatible with uses in and surrounding the C2 zone; 3. That some industrial uses are compatible with commercial planned developments; 4. That the planned development zones are designed to allow maximum flexibility in development design and that the more stringent review required of planned developments adequately protects surround- ing properties; 5. That certain inconsistencies were created by the passage of the Stor- age Warehouse Ordinance No. 80-08, which allows mini -warehouses in the CL, Cl and C2 zones when and as permitted by a CUP; 6. That automotive, motorcycle and boat dealerships are unusually likely to present outdoor storage and property development problems and that such uses may not always be compatible with uses in and surround- ing the C2 zone; 7. That these amendments are necessary and proper to accomplish the pur- pose and intent of regulating the permitted uses of industrial developments for the general health, safety and welfare of the public. Accordingly, the City Council of the City of Costa Mesa herewith amends Title 13 of the Costa Mesa Municipal Cade by amending Sections as hereinafter set forth: SECTION 2: Chapter II - Zoning Article 14 - Cl Local Business District Section 13-209. Conditional Uses. 1. Motel and hotels; 2. Auditoriums; 3. Dry cleaning plants; 4. Sports clubs and amusement centers; 5. Health clubs, spas and massage parlors; 6. Autcmotive, motorcycle and boat dealerships (including sales and service); 7. Service clubs engaged in public service and not operated primarily for profit; 8. Service stations; 9. Retail nurseries (no bulk fertilizer storage); 10. Preschools, day care centers, nursing homes and convalescent hospitals; 11. Mini -warehouses; 12. Other commercial uses not provided for as a permitted use may be considered for approval as a conditional use, according to the provi- sions set forth in this title; 13. Buildings in excess of two (2) stories or thirty (30) feet; 14. Any business activity which is limited to persons eighteen (18) years or older (excepting establishments engaged in on -sale beer, wine and liquor). (Ord. No. 78-125, S 2, 5-15-78). Article 15 - C2 General Business District Section 13-222. Permitted Uses. Permitted uses shall include but are not limited to: 1. All permitted uses in the Local Business (Cl) District; 2. Dry cleaning shops and plants; 3. Car washes; 4. Bowling alleys; 5. Glass cutting, edging and installation (including automotive and silverying of mirrors); 6. Heating and ventilating equipment sales and contracting; 7. Laundries; 8. Publishing and newspaper printing; 9. Retail nurseries (no bulk fertilizer storage); 10. Building supply and contracting; 11. Small animal hospital (kenneling only when incidental to prinicpal hospital use); 12. Tire sales and installation with incidental repair; 13. Upholstering shops, furniture repair and refinishing (no manufacturing) . Section 13-223. Conditional Uses. 1. All conditional uses in the Local Business (Cl) District. 2. Lumber yards. 3. Automotive body and paint shops. 4. Public gymnasiums, skating rinks, sports clubs and amusement centers. 5. Mini -warehouses. 6. Automotive, motorcycle and boat dealerships (sales and service). 7. Automotive repair. Article 15-1/2 \CL -Commercial Limited District Section 13-228. Conditional Uses. 1. Mini -warehouses. 2. Other uses which the planning commission determines to be consistent with the standards established in section 13-229 of this article. Article 17 Planned Development 13-251(2)(b). As a complimentary use, residential and industrial uses may be allowed if the city council finds said uses to be compatible with the planned development commercial project.
