HomeMy WebLinkAbout80-08 Amending Title 13, to Regulate Development and Use of Storage Warehouse FacilitiesI ORDINANCE NO. 80- S AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA AMENDING TITLE 13, OF THF COSTA MESA MUNICIPAL CODE TO REGULATE THE DEVELOP- MENT AND USF OF STORAGE WAREHOUSE FACILITIES. THE CITY COUNCIL OF THF CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLCWS: SECTION 1: The City Council of the City of Costa Mesa hereby finds and declares as follows: 1. That mini -warehouse and public -warehouse projects are different in many respects frcin other types and forms of development and therefore require different regulation. 2. That it is necessary and proper to regulate the intensity of mini -warehouse and public -warehouse development and the placement and design of such projects in order to protect the public health, safety, and general welfare. goals. 3. That existing requirements and standards are inadequate to accomplish these 4. That a state of market saturation exists which is inconsistent with the declared goals and objectives of the City's General Plan when there is more than 3 square feet of mini -warehouse space per capita. ACCORDINGLY, The City Council of the City of Costa Mesa herewith amends Title 13 of the Costa Mesa Municipal Code by adding Sections and Articles as here- inafter set forth: SECTION 2 CHAPTER XIII - SPECIAL REGULATIONS ARTICLE 1 - REGULATION OF STORAGE WAREHDUSFS S13-851 - Definitions The following words used herein shall have the meanings set forth: (1) A mini -warehouse shall mean a structure or group of structures for the dead storage of customer's goods and wares where individual stalls or lockers are rented out to different tenants for storage and where one or more stall or locker has less than 500 square feet of floor area. (2) A public warehouse shall mean a structure or group of structures for the dead storage of customer's goods and wares where individual stalls or lockers are rented out to different tenants for storage and where no stall or locker has less than 500 square feet of floor area. §13-852 - Permits Required (1) Mini -warehouse projects may be permitted in the Cl, C2, CL, and MG districts within the City, subject to the issuance of a Conditional Use Permit pursuant to the provisions of this Title. This requirement is in addition to other permits or certif- icates required by law. Mini -warehouse projects shall be subject to the development standards set forth in this chapter, and, where this chapter does not provide specific direction, the provisions of other applicable chapters and articles shall apply. (2) Public -warehouse projects may be permitted in the MG and MP districts within the City, subject to the issuance of a Conditional Use Permit pursuant to the provi- sions of this Title. This requirement is in addition to other permits or certificates required by law. Public -warehouses shall be subject to all development standards of the zone in which they are located. (3) The Planning Commission may deny a Conditional Use Permit for a mini -warehouse if there is more than 3 square feet of mini -warehouse space per capita as determined by the Development Services Department. If the 3 square foot per capita condition exists, before such a Conditional Use Permit can be approved, applicant for the CUP must show, and the Planning Commission must find, that there reasonably exists a need for the requested storage units which is likely to continue for the foreseeable future, and which is not likely to be met within a reasonable time by other sources. X13-853 - Mini -Warehouse Development Standards (1) Offstreet Parking and Driveway Width (a) One parking space shall be provided for each ten storage cubicles. Said spaces shall be equitably distributed throughout the project; and (b) Two covered parking spaces shall be provided adjacent to the manager's quarters; arra (c) One space for every 25 storage cubicles shall be located adjacent to the project office for the use of prospective clients. (d) Parking required under (a) above may be provided in full or in part in the form of parking lanes. Parking lanes shall be 10 feet wide and shall be in addition to a 26 -foot travel lane. Where adjacent buildings are not designed for vehicular access, 20 -foot travel lanes may be provided. (e) Required parking spaces may not be rented as, or used for vehicular storage. (2) Building Height Building height shall not exceed 12 feet. (3) Exterior Finish The exteriors of mini -warehouses shall be of finished quality. (4) Landscaping A landscaped strip 20 feet in width shall be provided along all street frontages and a landscaped strip 5 feet in width shall be provided where subject property abuts any residential district. The 5 foot landscaped strip abutting residen- tial property shall be designed to provide screening of the warehouse site from residential properties. (5) Sc eninc Project shall be screened by a 6 foot high decorative block wall to be installed along interior property lines and street setback lines under the direction of the Development Services Director. (6) Site Design Buildings shall be so situated and/or screened that overhead access doors are not visible from off site. §13-854 - Use Restrictions (1) No person, on premises covered by a Conditional Use Permit for either type warehouse, shall conduct: (a) Any business activity (other than rental of storage units) including miscella- neous or garage sales, and transfer/storage businesses which utilize vehicles as part of said business. (b) Servicing or repair of motor vehicles, boats, trailers, lawnmowers, or any similar equipment. (2) All mini -warehouse rental contracts shall include clauses prohibiting (a) the storage of flammable liquids, highly combustible or explosive materials, or hazardous chemicals, and (b) prohibiting the use of the property for uses other than dead storage. §13-855 - Live -In Manager for Mini -Warehouse Projects A resident manager shall be required on the site and shall be responsible for main- taining the operation of the facility in conformance with the conditions of approval arra all applicable ordinances. §13-856 - Conversion of Mini-warPhni,sPa fn ntho,- rl� A Conditional Use Permit shall be required for the conversion of a mini -warehouse facility to uses other than dead storage to ensure that the property shall be brought into conformance with all applicable provisions of the Land Use Ordinance, Uniform Building Code, Title 24 and 25 of the California Administrative Code, and any other applicable regulations.
