AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF COSTA MESA, CALIFORNIA,
PROHIBITING CERTAIN USES WHICH MAY BE IN
CONFLICT WITH CITY'S GENERAL ZONING RE-
GULATIONS CONCERNING ADULT USES AND DE-
CLARING SAID ORDINANCE TO BE AN URGENCY
ORDINANCE, SETTING FORTH REASONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1:
The City Council of the City of Costa Mesa
finds and declares that the health, safety and general welfare
of the public requires the prohibition of certain uses, to wit:
the sale or display of narcotics paraphernalia, in all zones,
and areas of the City which may be in conflict with a contemplated
zoning proposal.
Accordingly, the following urgency measure is adopted
pending further study and enactment of appropriate regulations
thereon:
SECTION 2: All uses, which are described hereinafter,
are hereby prohibited in all zones within the City and City staff
are directed not to issue any permits or licenses to persons or
entities for said uses for the duration of this Ordinance.
The prohibited uses are:
Any place selling or displaying for sale, any device,
contrivance, instrument or paraphernalia for smoking,
injecting or consuming marijuana, hashish, PCP, or any
controlled substances as defined in the Health and
Safety Code of the State of California other than
perscription drugs.
SECTION 3: The City Council of the City of Costa Mesa
finds and declares that the protection of the health, safety and
general welfare of the public requires that this ordinance be
adopted as an urgency measure, pursuant to California Government
Code §65858. The reasons in support of said urgency are as
follows:

A. There is an alarming increase in the pro-
liferation of commercial establishments catering to minors in
our community that sell such paraphernalia.
B. That such businesses or uses appear, at
present, to be unregulated although their items are generally
used by users of narcotics without regard to age.
C. That such items and their application to
narcotics users is, at least, akin to alcoholic beverages and
require some form of regulation as to location within zones
and on specific properties as an adult-oriented use.
D. That pending further studies and review by
City staff, who are hereby directed to do so, all such uses
are prohibited as herein set forth.
SECTION 4: This Ordinance shall take effect and be
in full force and effect immediately after its passage and be-
fore the expiration of fifteen (15) days after its passage,
shall be published once in the Orange Coast Daily Pilot, a
newspaper of general circulation printed and published in
the City of Costa Mesa, together with the names of the members
of the City Council voting for and against the same.
