HomeMy WebLinkAbout83-06 Amending 72-Hour Vehicle Parking ProvisionI i ORDINANCE NO. 6`3-'(6 AN ORDINANCE OF.THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING THE 72 -HOUR VEHICLE PARKING PROVISION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the, City of Costa Mesa hereby finds and declares as follows: 1. The City has a law which prohibits parking a vehicle on the street for more than 72 consecutive hours. 2. The purpose of this law is to prohibit the storing of vehicles on public streets, to promote safe, clean and aesthetic streets and neighbor- hoods, and to allow the equitable use of the streets by all nearby property owners and their guests for temporary parking. 3. The existing law needs to be strengthened to prevent its circum- vention by, among other ways, merely moving a vehicle an insignificant distance or removing a vehicle from its parking place for an insignificant period of time. ACCORDINGLY, the City Council hereby amends the Costa Mesa Municipal Code as follows: SECTION 2. 1. Amend Section 10-185(b) to read: "(b) No person who owns or has possession, custody, or control of any motor vehicle (as defined in Sec- tion 670 of the California Motor Vehicle Code), excluding those covered in subsection (a) above, shall park, or leave standing, such a vehicle upon any street for more than a period of 72 consecutive hours. This subsection is violated if: (1) At the end of such period the vehicle is parked in the same place as the beginning of such period and physical marking or other facts indicate that the vehicle has not been moved; or (2) At the end of such period the vehicle is parked on the street within 1,056 feet of where it was parked at the beginning of such period, unless the owner or custodian establishes that the vehicle has been moved more than 2/10 of one mile for at least 3 consecutive hours; or (3) During such period the vehicle has not been removed from its parking place to a loca- tion off the public street or more than 1,056 feet away for a period of at least 3 consecutive hours." E 2. Amend Section 10-185(c) to read: "(c) Vehicles found parked in violation of this Section may be cited, removed, or both, in accordance with the provisions of Section 10-69." SECTION 3. This Ordinance shall take -effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
