HomeMy WebLinkAbout82-15 Construction Standards for Mobile Homes and Mobile Home Parks in Flood Hazard AreaORDINANCE NO. 82-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING ARTICLE 17-1/2, TITLE 13 OF THE COSTA�MESA MUNICIPAL CODE TO INCORPORATE CONSTRUCTION STANa4mS FOR MOBILE HOMES AND MOBILE HOME PARKS AND SUBDIVISIONS LOCATED IN THE FLOOD HAZARD AREA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares as follows: A. That the City Council adopted Ordinance 80-24 to establish regulations pertaining to flood plain land use and development pursuant to the requirements of the National Flood Insurance Program (42-U.S.C. 4001-4128). B. That Ordinance 80-24 has.been reviewed by the Federal Emergency Manage- ment Agency. C. That the Federal Emergency Management Agency has determined that it is necessary to incorporate additional construction standards for mobile homes and mobile hone parks and subdivisions into'the City's existing flood plain land use and development regulations. ACCORDINGLY, the City Council of the City of Costa Mesa herewith amends Article 17-1/2, Title 13, as hereafter set forth: SECTION 2. 1. Amend Section 13-258, Definitions, by adding the following: 11(21) Mobile Home: Any structure that is transportable in one or more sections, built on a permanent chassis, and designated to be used with or without a permanent foundation when connected to the required utilities. It does not include recreational vehicles or, travel trailers, or manufactured housing on a permanent slab foundation. (22) New Mobile Home Park or Subdivision: Any parcel (or contigu- ous parcels) of land divided into two or more mobile home lots for rent or sale for which the construction of facilities or servicing the lot (including, at a minimum, the installation of utilities, either final site grading or the pouring of concrete pads, and the construction of streets) is completed on or after the effective date of the Ordinance." 2. Amend Section 13-261(7) to read as follows: i "(7) Construction standards for mobile homes and mobile hone parks and subdivisions. (a) All mobile homes and additions to mobile hones shall be anchored to resist flotation, collapse, or lateral move- ment by one of the foi llowing methods: 1. By providing an anchoring system designed to with- stand horizontal forces of 15 pounds per square foot and uplift forces',of 9 pounds per square foot; or 2. By anchoring of the units, designed to be in compli- ance with the Department of Housing and Cammunity Development Mobile Hone Construction and Safety Standards (Title 25, California Administrative Code, Installation Regulations). (b) The following standards are required for (1) mobile homes not placed in mobile home parks or subdivisions, (2) new mobile hone parks or subdivisions, (3) expansions to existing mobile hone parks or subdivisions, and (4) repair, reconstruction, or improvements to existing mobile home parks,or subdivisions that equal 50 percent or greater of the value of the streets, utilities, and pads, before the repair, reconstruction, or improvements commenced: 1. Adequate surface drainage and access for a hauler shall be provided. 2. All mobile homes shall be placed on pads or lots elevated on compacted fill or on pilings so that the lowest floor of the mobile home is at or above the base flood level. If elevated on pilings: a. the lots or pads shall be large enough to acccnmodate steps; I b. the pilings shall be placed in stable soil no more than ten feet apart; and c. reinforcement shall be provided for pilings more than six',feet above ground level. (c) Written certification' of compliance with the standards con- tained in this section shall be provided by the installer of the mobile hone, the developer of the mobile home park or subdivision, or the State agency responsible for regu- lating placement. Such certification shall be maintained - 2 - on file by the Development Services Department for flood insurance purposes. (d) No mobile home shall be placed in a floodway or the FP -I District, except in an existing mobile home park or sub- division." 3. Add Section 13-261(8) as follows: "(8) Findings: Application for a permit may be denied where the Development Services Director is unable to make each of the follow- ing findings: (a) The development will 'not produce a significant risk to human life in the event of the design flood. (b) The development is designed and sited so as to offer minimal obstruction to the flow of floodwater. (c) The development will not create a potential hazard or otherwise adversely affect property because of diver- sions, increased heights or velocities of floodwaters or because of increased debris or otherwise adversely affect the safety, use, or stability of any public way, drainage channel, or adjacent property during a flood condition. Applicants for permits as provided for herein shall be required to submit studies, plans, or other evidence prepared by a registered professional engineer or, architect to support the required findings necessary for approval of the permit." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior, to the expiration of fif- teen (15) days from its passage shall be;published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adop- tion of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same. r ATTEST: PASSED AND ADOPTED this lst day of November, 1982.
