O cA.�O AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,- AMENDING TITLE 13 OF THE COSTA MESA MUNICIPAL CODE REGARDING PARKING REQUIREMENTS IN RESIDENTIAL DEVELOPMENTS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares as follows: 1. That the City Council approved the concept of using small car parking spaces in commercial, residential, and industrial developments when the Council adopted Ordinance No. 80-16 regulating off-street parking; 2. That the City of Costa Mesa has adopted Standards and Policies for the utilization of small car parking spaces within residential, commercial, and indus- trial zones; 3. That permitting twenty-five percent (250) of all unassigned parking spaces in residential developments to be; small car spaces is consistent with the Policies and Standards of the City of Costa Mesa; 4. That additional amendments to existing requirements for parking in residential developments are necessary to resolve internal inconsistencies and to clarify ambiguities. ACCORDINGLY, the City of Costa Mesa herewith amends Title 13 of the Costa Mesa Municipal Code as hereafter set forth. SECTION 2. 1. Amend Section 13-142, Subparagraph 6: "6. Straight -in driveways to garages shall have a minimum length of 19 feet (19') from the ultimate property line." 2. Amend Section 13-545(a)(2): "(2) R2, R3, R4, PDR -LD, PDR -MID, PDR -HD, PDR -UC, and residential components of developments in the PDC and PDI zones. There shall be a minimum of one covered parking space for each dwelling unit within any of these zones except that development governed by provisions of Sections 13-819 to 13-850, inclusive, 'Regu- lation of Condominiums', shall provide parking according to Section 13-828(f) and detached dwelling units in the PDR -LD, PDR -M, PDR -HD, and PDR -UC zones shall provide parking according to Section 13-545(a)(3)." 3. Add Section 13-545(a)(3): "(3) Detached dwelling units on individual lots in the PDR -LD, PDR -PAID, PDR -HD, and PDR -UC zones. Detached dwelling units served by a public or private street with a roadway width (distance measured between opposite curb faces) of thirty-six feet (361) or more, shall be provided with parking according to Section 13-545(a)(1). Detached dwelling units served by a public or private street with a roadway width (distance between opposite,curb faces) less than thirty-six feet (361) shall be provided with parking according to Section 13-828(f)." 1 4. Amend Section 13-545(b): "(b) Open space parking. In addition to the covered parking require- ments as set forth herein, the following'open space parking requirements shall be met: (This subsection does not apply to development in the Rl, Rl-E, and Rl W zones nor to developments governed by provisions of Sections 13-819 to 13-850, inclusive, 'Regulation of Condoniniums','or by provisions of Section 13-545(a)(3)). (1) Resident Parking: a. Zero- or one -bedroom units (to include studio, efficiency, bachelor, and other similar terms) shall provide one-half (0.5) uncovered space per unit. b. Two-bedroan units shall provide eight -tenths (0.8) uncovered parking space per unit. c. Units with three (3) or more bedrooms shall provide one uncovered parking space per unit. (2) Guest Parking: Each multiple -family development shall provide guest - 2 - parking in accordance with the following standards: a. Guest spaces shall be provided at the ratio of one-tenth (0.1) space per unit. b. Guest parking shall be clearly marked and permanently maintained for individuals visiting within the development. Fractions above forty-nine hundredths (0.49) shall be rounded up." 5. Amend Section 13-547: Small Car Parking "Twenty-five percent (25%) of all,unassigned parking spaces may be small car spaces. Said small car spaces shall comply with City of Costa Mesa standards and shall be clearly marked 'SMALL CAR ONLY" under the direction of the Director of Development Services. Unassigned parking spaces shall include all guest spaces in condominium developments (as defined in Section 13-819(e)) and all parking spaces in apartment developments, excluding one (1) covered space per dwelling unit. Additional parking may be designated as ,'unassigned' when and as authorized by the Planning Commission." 6. Amend Section 13-828(f)(1): ' "(1) Each unit shall be provided with two (2) covered parking spaces which shall be adjacent to the unit being served. At least one (1) of these spaces shall be an enclosed garage. All spaces shall, maintain a minimum inside dimension of ten feet (10') in width and twenty feet (20') in length. Within the R3, R4, PDR -HD and PDR -UC zones, alternate parking designs may be approved if the Planning Commission finds that the design contributes to the overall design excellence of the project and furthers the City's housing objectives as defined in the General Plan." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fif- teen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a - 3 - summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adop- tion of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same.
