AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, AMENDING SECTION 13-3 OF
THE COSTA MESA MUNICIPAL CODE RELATING TO TERMS
OF PLANNING COMMISSIONERS AND ADDING A RESIDENCY
REQUIREMENT.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION.1. The City Council of the City of Costa Mesa finds and declares
that a change in the General Municipal Election date from April of even num-
bered years to November of even numbered years and a change of the City Council
terms of office from April of even numbered years to November of even numbered
years -'has brought about the necessity of changing the terms of office of the
existing Planning Commissioners. Additionally, in the best interests of carry-
ing out the business of the City of Costa Mesa, the City Council finds it
necessary to make a residency requirement for Planning Commissioners.
SECTION 2. Section 13-3 of Title 13 of the Costa Mesa Municipal Code is
amended as follows:
Section 13-3 Commissioners' terms of office; residency.
(a) Members of the City Planning Commission shall be appointed for four
(4) year terms subject to the provisions of Section 13-2.
(b) Two (2) members shall serve terms which end on December 31, 1982,
and subsequent appointments to those two (2) positions shall continue
for four (4) years commencing January 1, 1983. Three (3) members
shall serve terms which end on December 31, 1984, and subsequent
appointments to those three (3) positions shall continue for four (4)
years commencing January 1, 1985. The terms of the current members
are extended six (6) months so they will terminate on the above dates.
At the end of said terms said appointments shall terminate and the
positions deemed vacant without further action of the Council; provided,
however, that members may be appointed for additional terms at the
Council's discretion.
(c) No person shall be appointed nor serve as a member of the Planning
Commission who is not a resident -of the City of Costa Mesa. If
while serving a member ceases to be a resident, his position shall be
deemed vacant as of the change in residency and a new member shall be
appointed to complete that term of office.
SECTION 3: This Ordinance shall take effect and be in full force thirty
(30) days from and after the passage thereof, and prior to the expiration of
fifteen (15) days from its passage shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation, printed and published in the
City of Costa Mesa or, in the alternative, the City Clerk may cause to be pub-
lished a summary of this Ordinance and a certified copy of the text of this
Ordinance shall be posted in the office of the City Clerk five (5) days prior
to the date of adoption of this Ordinance, and within fifteen (15) days after
adoption, the City Clerk shall cause to be published the aforementioned summary
and shall post in the office of the City Clerk a certified copy of this Ordi-
nance together with the names of the members of the City Council.voting for
and against the same.
