AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ESTABLISHING STANDARDS
AND PERMIT REQUIREMEN'T'S FOR SIDEWALK SALES AND
PARKING LOT SALES.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS

SECTION 1. The City Council of the City of Costa Mesa hereby finds
and declares as follows:
1. That Title 13 of the Municipal Code requires all activity in
commercial and industrial zones to be conducted underroof;
2. That the conduct of sidewalk sales and parking lot sales on an
infrequent basis is considered normal and incidental to the operation of
businesses in these zones;
3. That the infrequent conduct of such sales is not materially
detrimental to the public health, safety, or welfare and does not signifi-
cantly compromise the integrity of current standards requiring activities
to be conducted underroof;
4. That policies allowing sidewalk sales and parking lot sales
require issuance of business permits for administrative record-keeping
purposes.
ACCORDINGLY, the City Council of the City of Costa Mesa herewith
amends the Costa Mesa Municipal Code as hereinafter set forth.
SECTION 2.
1. Add Section 9-125(t) as follows:
"(t) Sidewalk sales and parking lot sales."
2. Add Section 9-128(1) as follows:
"(i) Sidewalk sales and parking lot sales."
3. Amend Section 13-237.3 as follows:
113. All permitted and conditional uses shall be conducted
"underroof", as said term is defined in Section 13-64
of the Costa Mesa Municipal Code, with the exception
of sidewalk sales and parking lot sales which may be
allowed on the basis of a maximum of four sales per
fiscal year with a maximum length of three days per
sale and subject to obtaining a business permit as
required in Section 9-128."
4. Amend Section 13-420(b) as follows:
"(b) Uses underroof: All uses shall be conducted under -
roof except, as may be permitted by a Conditional Use
Permit, and except sidewalk sales and parking lot
sales which may be allowed on the basis of a maximum
of four sales per fiscal year with a maximum length
of three days per sale and subject to obtaining a
business permit as required in Section 9-128."
SEC'T'ION 3. This Ordinance shall take effect and be in full force
thirty (30) days from and after the passage thereof, and prior to the
expiration of fifteen (15) days from its passage shall be published once in
the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed
and published in the City of Costa Mesa or, in the alternative, the City
Clerk may cause to be published a summary of this Ordinance and a certified
copy of the text of this Ordinance shall be posted in the office of the
City Clerk five (5) days prior to the date of adoption of this Ordinance
and within fifteen (15) days after adoption, the City Clerk shall cause to
be published the aforementioned summary and shall post in the office of
the City Clerk a certified copy of this Ordinance together with the names
of the members of the City Council voting for and against the same.
PASSED AND ADOPTED this 20th day of June, 1983.
