HomeMy WebLinkAbout83-19 Establishing a Moratorium on Processing and Issuance of Zone Exception PermitsORDINANCE NO. 83-19 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALFORNIA, ESTABLISHING A MORATORIUM ON THE PROCESSING AND ISSUANCE OF ZONE EXCEPTION PERMITS FOR THE CONVERSION OF EXISTING APARTMENTS TO CONDOMINIUMS, EXCEPT WITHIN THE BOUNDARIES OF THE DOWNTOWN REDEVELOP- MENT PROTECT AREA NO. 1, DECLARING SAID ORDINANCE TO BE AN URGENCY ORDINANCE AND SETTING FORTH THE REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOL - SECTION 1. The City Council of the City of Costa Mesa finds and de- clares that there is a current and immediate threat to the public health, safety, and general welfare and that the approval of additional Zone Exception Permits, or other applicable entitlements for the conversion of existing apartments to condominiums, except within the boundaries of the Downtown Redevelopment Project Area No. 1, would endanger the public health, safety, and welfare. Accordingly, the following urgency measure is adopted. SECTION 2. The City Staff is hereby directed not to process nor issue any permits of any kind for the conversion of existing apartments to condaniniums, except in the Downtown Redevelopment Project Area No. 1, for the duration of this Ordinance, provided that any application for City action that has been filed with the City, or permit issued by the City before July 18, 1983, shall not be denied, enjoined, or otherwise prevented frau being pursued or canpleted solely by reason of the adoption of this Ordinance. Such projects may be processed or completed if otherwise approved by the City. SECTION 3. The City Council finds and declares that the protection of the public health, safety, and general welfare requires that this Ordinance be adopted as an urgency measure, pursuant to Section 65858, California Goverment Code. follows: The reasons in support of the necessity of an urgency measure are as The City Council adopted Ordinance 77-41 to regulate the development of new condominiums and the conversion of existing apartments to condominiums; The City Council has approved amendments to Ordinance 77-41 to provide increased opportunities to convert existing apartments to condominiums under cer- tain prescribed conditions; The approval of condominium conversions under certain prescribed con- ditions can fulfill certain goals established for the long-term improvement of the Downtown Redevelopment Project Area No. 1; That additional time is required to test and to assess the implications of recent amendments to Ordinance 77-41 in the Downtown Redevelopment Project Area No. 1 prior to the application of these amendments throughout the entire co m- munity; This emergency/urgency ordinance will assist the Council in monitoring the condominium conversion process, and the effectiveness of the Ordinance 77-41 regulating condominium conversion of existing apartments in the Downtown Project Area No. 1, and the effects of the conversion process on the public health, safety and welfare. This emergency/urgency ordinance which establishes a moratorium on con- dominium conversions in all areas of the City of Costa Mesa, except the Downtown Project Area No. 1, will enable the Council to monitor that the needs of displaced (2) tenants, particularly senior citizens, low -moderate inane families, and families with school age children, are adequately considered in conversion process, and this ordinance will enable the Council to monitor and ensure that conversions con- form to adopted General Plan policies. That the conversion of existing apartments to condaniniums throughout the entire community, except in the Downtown Redevelopment Project Area No. 1, would endanger the public health, safety, and welfare. SECTION 4. This Ordinance shall take effect and be in full force in - mediately frau and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against same.
