THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORMIN AS Wei 9 us,.M SECTIM 1. 1. There is a significant difference between ramps in parking garages which provide direct access to parking and those which do not; 2. That ramps which do not provide direct access to parking can safely be designed at a steeper slope than those which do; 3. That it will facilitate consideration of Conditional Use Permits requesting steeper ramp slopes than this ordinance specifies if criteria for consideration are included in the ordinance; 4. That these regulations are necessary and proper to accomplish the purpose and intent of regulating the nature of off-street parking for the public health, safety, and general welfare; 5. That existing requirements and standards are inadequate to accom- plish these goals. Accordingly, the City Council of the City of Costa Mesa herewith amends Title 13 of the Costa Mesa Municipal Code by amending Section 13-559(h) as hereinafter set forth: SECTIM 2. Amend Section 13-559(h) to read: "13-559(h) (1) A ramped driveway exit rising up to a public sidewalk shall have a transition section at least sixteen (16) feet long with a maximum slope of five (5%) percent. (2) The maximum slope for ramps with direct access to parking shall be five (5%) percent. (3) The maximum slope for a transition ramp with no direct access to parking shall be ten (10%) percent except where and as approved by a Condi- tional. onditional Use Permit. In no case shall ramp slope exceed seventeen (17%) percent. The following factors may be considered justification for approv- ing a request for a Conditional Use Permit to exceed ten (10%) percent ramp slope: (a) When no pedestrians, including handicapped persons, will be using the ramp; (b) When the ramp is straight; (c) When the traffic volume of the parking structure is low; (d) When the structure is for employees only; (e) When transition slopes are provided which are at least 12 feet long and have a slope equal to one-half the ramp slope; (f) When all ramps within the structure have a consistent slope and design; (g) When there are no 'blind spots' within the ramp or transition areas." SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation,printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the.members of the City Council voting for and against the same.
